Timeline

Came in on K1, Applied for AOS in End of October 2007, Interviewed in March 2008.. interviewer told that my NAME CHECK is not back yet.. and he will check that again.

no answer yet..

so i scheduled an infoPass Apointment went there last week, an officer looked in and said that 'waiting on a file' and name check is not back yet. (i talked about 180 days new bill..) she said it should be sooner now... wait few more days ..and keep coming back here. i scheduled an other INFOPASS Now

My EAD will expire in the end of december.. my question is about EAD.. if i dont get GC before it expires.. what i will have to do?? will i have to pay 345$ for new ead?? how long should i wait before applying new EAD.

I know that I had to pay each time I renewed my EAD while waiting for my AOS to be approved. That was before the re-configuration of the fee change, though, so I don't know if it is still the case. Regardless, there must be information with the application for an EAD that gives this information. You might want to check there first.

Ok - found the information (figured it was just as easy for me to look it up :-) - looks like you don't need to pay for a renewal if you filed for the I-485 after the price increases last year, but you do if you filed before that.

Note on Filing Fee:

If you are in one of the categories noted below, no fee is required.

No fee is required if filing for an initial EAD under one of these categories:

* Refugee, asylee or paroled as a refugee;

* N-8 or N-9 Nonimmigrant;

* Citizen of Micronesia, Marshall Islands, or Palau;

* Granted Withholding of Deportation;

* Deferred Enforced Departure;

* Dependent of certain foreign government or international organization personnel; or,

* Applicant for asylum (applicant filing under special ABC procedures must pay the fee however).

No fee is required if filing for a renewal EAD under any of these categories:

*

Citizen of Micronesia, Marshall Islands, or Palau;

*

Granted Withholding of Deportation;

*

Deferred Enforced Departure; or,

*

Dependent of certain foreign government or international organization personnel.

If you are filing for a replacement EAD, and you are a dependent of certain foreign government or international organization personnel, no fee is required to file this form.

If you are filing this application concurrently with Form I-485, Application for Permanent Residence, no fee is required to file this form. As of 07/30/07, if you file your Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, as a receipt of evidence for the filing of your I-485.

If you are filing for an extension of your Employment Authorization and your Form I-485, Application for Permanent Residence, was filed before July 30, 2007, then you must pay the $340 filing fee."

I would file for the extension no later than 90 days/3 months prior to the EAD's expiry. It generally takes about 90 days to process so you may wish to allow yourself some leeway by filing even earlier than that.

I-765 right? Was optional and recall about 700 bucks extra for my wife and daughter. Have these EAD cards on my computer, dated 01/18/2005 and expired on 01/17/2006, but their green cards were issued on 06/27/2005 so didn't feel I got my money's worth, LOL.

Is the USCIS taking a lot longer now with I-765's?

"If you are filing this application concurrently with Form I-485, Application for Permanent Residence, no fee is required to file this form. As of 07/30/07"? Hmmm, we had to pay extra for the I-765 as we filed with the I-485, but the biometrics included both the EAD and the green cards.
