Hi I am here again we will be in the court next week for the final of our divorce and my greencard will be expire next year june 12, 2009, and I am really very nervous going there, my husband and I has no children and we sign the papers and both agreed of everything on what we settled, what kind of papers do I need to bring their with me? is the court will deport me after it finalized? what am I going to do for myself to be there? hope anybody can help me urgently please.

No!!! who told you that the divorce court will deport you??? you have all the right to stay legally in the US! when your tile to file I751 to remove conditions of your green card cames (which the window opens 90 days prior of expiration) you would have to fill up a waver. You have to send evidence showing that you entered the marriage in good faith but for XX reasons the marriage fail! USCIS are the only ones that can "deport" you. You are still with a legal status otherwose said by USCIS. Hope it helps, you should also seek same legal advise when the time cames!

09/20/2007 Went to get an stamp, denied stamp at the Miami USCIS Office =(

01/31/2008 Transfer to Vermont Service Center (after almost 8 months!)

02/22/2008 This case is now pending at the office to which it was transferred.

02/26/2008 This case is now pending at the office to which it was transferred. (Last Touched)

07/01/2008 : still waiting for a miracle after 390 days of suffering....

07/02/2008: Infopass Appointment. passport Stamp....

07/03/2008: Incredible!!!! Card Production Ordered!!!!!!

07/04/2008: Touched. Duplicate email Card Production Order

07/07/2008: Touched

07/08/2008: Touched. Email with notice of approval

07/09/2008: Touched again!

07/11/2008: CARD ARRIVES IN MAIL!!!!! THANKS!!!! WELLCOME IMMIGRANT LETTER!!! :P

Naturalization Process:

06/23/2010: 06/23/2010 - Send N400 after 5 years of permanent residency. Good luck !

Actually, you won't have to wait until the 90 day window opens up. Once the divorce is finalized you can file the I-751 with no further delay. The 'waiver' is actually a part of the form itself - it is at the bottom. You check off the place where it says you are filing on your own and are requesting a 'waiver' from filing jointly with your husband because you are now divorced. You will still need to prove that your marriage was a real marriage and not solely to get a green card. Hopefully the divorce decree will require your ex-husband to continue to support you while you start your new life on your own. He is still responsible for making sure you do not require public assistance even after you are divorced. You do not need to leave the US unless you want to. You will not be deported. Divorce court is a totally different court than immigration and has nothing to do with your immigration status at all. Good luck.

That is totally correct.. excuse me!! I forgot that once your divorce is finish you do not have to wait for the 90 days!!! sorry!
