Instructions for I-864 have an error

OK everyone, just check this out:

The following is from the instructions (Rev. 10/18/07) on p. 2

Who Completes and Signs Form I-864?

...

The US citizen or lawful permanent resident who filed a Form I-130 for a family member, Form I-129F for a fiance(e), or Form I-600 or I-600A

for an orphan.

As a K-1 I fall under this case, since my US citizen wife (now) and ex-fiancee had filed a Form I-129F for a fiance on my behalf in the past. OK, so far so good. My wife will have to petition for me on the above basis (as we already knew of course).

Now go to "Step-by-Step Instructions" on p. 5

Check box 'a' if you are the petitioner who is filing or who has already filed Form I-130, Petition for Alien Relative; Form I-600, Petition to Classify Orphan as an Immediate Relative; or Form I-600A, ...

Note that a petitioner who has filed Form I-129F is NOT mentioned here. However, if one examines all other cases (b through f) they can easily deduce that none of the other categories correspond to the petitioner for a fiance(e).

So my question is: which option do we tick here? :blink:

when completing an 864, it should be for an aos, which means u are married to ur fiance, so u are now petitioning for your alien relative.

04/30/08 - POE Newark

07/06/08 - Wedding..... I'm Married Yall!!!

I130 for Minor Child

7/26/12 - Sent to Chicago Lockbox

7/30/12 - Priority date

3/15/13 - NOA2!!!!!!!

3/25/13 - NVC received my case

4/08/13 - Emailed ds3032 template

4/09/13 - NVC case number and IIN number generated

4/11/13 - aos fee bill invoiced/paid/and pkg sent

4/12/13 - aos fee paid again after being rejected/ds3032 resent and accepted

4/15/13 - aos pkg delivered/iv bill invoiced and paid

4/16/13 - iv pkg sent express mail/ aos status changed to paid

4/17/13 - iv pkg delivered/ iv status changed to paid.

4/29/13 - Case Complete!

5/10/13 - Interview notice emailed.

6/05/13 - INTERVIEW

06/07/08: Wedding

06/20/08: Applied for new SS# with married name

06/27/08: Received new SS card with married name

06/30/08: I-485 AOS packet sent to Chicago

07/01/08: I-485 AOS packet received by CHIBA/RECEPTION (1 day)

07/08/08: I-485 check cashed by USCIS (9 days)

07/11/08: Received NOA's - 4 letters - I-485 NOA, EAD NOA, AP NOA, Biometrics Appt. (12 days)

07/29/08: Biometrics Appt. 11am (30 days)

07/29/08: I-485 Application transferred to CSC (30 days)

08/04/08: Received Transfer Notice in mail from CSC (36 days)

09/03/08: Touched - Email - I-485 AOS Card Production Ordered (66 days)

09/04/08: Touched - Email - Notice mailed welcoming new permanent resident (67 days)

09/04/08: Received AP in the mail (67 days)

09/05/08: Touched - Email - EAD approved (68 days)

09/08/08: Received EAD in the mail (71 days)

09/09/08: Touched - Email - I-485 AOS Approval Notice Sent (72 days)

09/09/08: Received notice in the mail welcoming new permanent resident (72 days)

09/10/08: Received GREEN CARD in th email (73 days)
