K-1 Sent Off and I have a Question.

Timeline

My K-1 is on it's way to Vermont and I am so nervous. I was wondering if anyone could tell me, what would be the reasons it would be turned down? I provided copies of my Entry Visa, 6 months Tourist Visa, boarding passes and Itineraries for 3 trips i've made, receipts from shopping, pictures, and I also mentioned I had a co-sponsor.

My journey hasn't even begun and i'm already a wreck. :( I'm just afraid I missed something, I should've included or they'll just turn us down flat. Is it very often they ask for more evidence at this stage? I appreciate your repsonses.

2/28/08 - 2nd Visit..

6/03/08 - 3rd Visit..

9/10/08 - 4th Visit..

7/14/08 - Sent off I-129

1/18/09 - RFE

1/30/09 - NOA2

???? - 45 Days of AP at NVC

03/15/09 - Left NVC

03/26/09 - Received pct. 3

05/06/09 - sent pkt back.

05/08/09 - Received pkt. 4

05/12/09 - Interview

07/24/09 - Out of AP

07/30/09 - Sent passport to Embassy.

08/15/09 - Received Passport with Visa.

08/18/09 - POE: Atlanta. It went very smooth, no problems at all. In and out in 30 minutes.

10/05/09 - Sent AOS/EAD

10/19/09 - Rec'd NOA

11/05/09 - Transferred to C.S.C.

11/10/09 - Biometrics - Cancelled waiting for new appt.

12/21/09 - Biometrics - Went well with no problems.

12/31/09 - EAD Card received.

02/16/10 - Transferred to Lee's Sumit, Mo

03/04/10 - Recieved AOS Interview letter.

04/07/10 - A.O.S. Interview - Approved. Very easy interview.

04-26-10 - 2Yr. Green card Received.

Hi Jolie

Draw a deep breath, relax and everything will be fine :thumbs: you guys will be approved in approximately 3 months time!! From what you have mentioned you have met all the requirements of the K1 including having met within the last 2 years.

Reasons they could deny your petition on a K1:

1) If either party is already married

2) The beneficiary has an extensive bad criminal record..

3) can anyone else chip in?!

If you have missed something out of your paperwork they shall consult you with an RFE normally between the stages of NOA1 and NOA2. CIS never usually deny a petition based on a missing piece of paper. I think the waiting game will cause the wrecked nervous part of you to disappear... as soon as you receive your NOA1 all you have to do is wait for your NOA2. Good luck!!

They can turn you down if you provide insufficient evident. Most likely they will issue you RFE (Request for Evidence) at this early stage. I am assuming you did files all requires paper (I-129F, G-325A,

I-134(w-2, paystubbs, company letterhead, and among other things etc). You may be forgetting to including a letter of intend by both of you (bona-fide) and an engagement letter. This letter is very important. Hope this help a bit.

They can turn you down if you provide insufficient evident. Most likely they will issue you RFE (Request for Evidence) at this early stage. I am assuming you did files all requires paper (I-129F, G-325A,

I-134(w-2, paystubbs, company letterhead, and among other things etc). You may be forgetting to including a letter of intend by both of you (bona-fide) and an engagement letter. This letter is very important. Hope this help a bit.

You dont send the I-134 W2 paystubs company letterhead with the K1 Visa you need thoose papers later for the interview

Other reasons for getting turned down in addition to the above: the petitioner having filed for more than the allowed petitions/visas within a specified time period, the beneficiary having a specific health condition that can't be effectively cured/treated, the beneficiary having a poor moral character; not having met face to face within the last two years; not being able to satisfy the affidavit of support requirements; not convincing the interviewer that you have a true relationship (more significant in high fraud countries), etc. Usually, if there is a problem regarding evidence they will ask for further evidence (RFE). If there is an obvious barrier to a visa (criminality, immoral character, not having met within last 2 years, etc.) they will deny either the I-129f application or the K-1 depending on where the issue is identified. For what it is worth, the majority of I-129f petitions are granted and a good many of the K-1 visas are also granted, although some take longer to others due than delays involving background checks. O.K. I sent the I-129f, G-325A, pictures, letter of intent from both of us, boarding passes, itineraries, receipts, passport copies, and included that I had a co-sponsor. I didn't send an engagement letter.. I didn't read anywhere that this was to be included, but I did send our letters of intent to marry W/I 90 days.

I have never filed more than one petition, I don't have a health condition to cause worry, I have no worries of my character always been a good person, I've been with him since January, so, i've met him w/i 2 years, I have a co-sponsor, and I hope I provided them with enough proof we have a relationship. :P

I'm just scared like I know all of us are or have been that something will go wrong. I wish us all the best of luck.

I think we all probably felt this initially as the packet was sent. Even though we went over it a hundred times... panic sets in once it's out of our hands. ;) It seems you sent everything needed. I'm sure what you're feeling is pretty normal.

The only other reason i've seen Vermont send the entire petition back is the wrong amount on the check and if the check address does not match the petitioner's address (like you used checks with an old address). That doesn't seem to happen with CSC though.

I know I kept going over and over the petition...I think we all worry we will leave something out :)

My husband is a detailed person. So after hours of going over everything on the phone over and over and over.... :blink: We finally decided it was time. I sent it. And felt like you do now. But good news was it went fine.

Warning though, this is just the beginning of anxiety. More to come .. As the process continues.

You sound like you got it all right, and if there is one piece missing they will send you a notice to send it in. It will not get turned down but will just delay it a little. so relax you have much more time to stress.

Did you remember to put the $455 check in the packet? Did you mail it to Vermont? Sounds like you've mentioned all the other pieces. Congratulations on starting the anxiety ridden journey. It's not that hard, but our emotions really act up during the waiting because we've done our part and have no clue what's going on at the other end. :wacko:

There are basically four criteria the petition must meet:

1. Petitioner proves they are a US citizen.

2. Petitioner and beneficiary prove they are free to marry.

3. Petitioner and beneficiary prove they have intent to marry.

4. Petitioner proves they have met the beneficiary within the last two years.

Past criminal convictions of the USC can cause a denial. Prior filings for other aliens can cause a denial. Aside from these matters, getting an I129F petition approved is fairly simple.

Getting a visa approved by the consulate can be trickier.

Well I just sent in my package and I realized the check I sent has an old address on it. I live in NH so the Vermont processing center may be used. Should I be prepared to have the whole package rejected because of the check?

If your check can still be cashed, it will be fine. If it bounces, the package will be sent back.
