Timeline

Hey guys!!

Its been just over three months and we still have not recieved anything since our NOA1; yes, we have the CSS...

Firstly, *screams* this is so unbeliveably frustrating! :whistle::crying:

Secondly, how long do we have to wait before we could get our US/Australian local members of Government involved?

I have heard things that if you waiting for more than 6 months then you can pressure them to get it expedited?

Fact or fiction???

Thirdly, my partner is coming out from the mighty USA to stay with my in Australia for the next few months (so excited!).

His family are going to keep a watchful eye on the post for possible REF's (hopefully not though) and NOA2's.

Anything else we should consider before he comes out??? We have everything signed and ready to go as soon as the NOA2 is issued.

Would they take into account (does it work in our favour) that my partner has had his Australian 1year VISA approved and he is going to be out in Australia??

waiting game is between a month to 6 months for NOA2 to arrive, or even getting RFE... you had another 3 months before seeking help. You can also check your status online, so you'll know it before your actual confirmation NOA2 (I-797) paper arrived in the mail.

They have the NOA1...the post says that they haven't received anything SINCE the NOA1.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

Unfortuantely, you will just have to be patient and wait it out. We waited 234 days from NOA1 date until the NOA2 date. I thought the day would never come, but after getting our Congressman's office involved, the CSS finally budged.

After that, the petition flew through the NVC and onto the Embassy in Kiev and we have an interview scheduled for August 19th - this date is exactly 10 months from the day we filed the K1 on October 19th of 2007....

Firstly: I completely understand! Check out my timeline in my siggy...the wait is horrible. My fiance and I both have full time jobs and can't be together for months. We see each other every few months, and we're one of the lucky ones. Check out BlakeandOlha or Sunnybear, they haven't seen their fiance/es in 200+ days (Sunny just hit over a year).

Secondly: I filed in February and am hitting my five months. A lot of February filers are still waiting to hear anything, so you've got a bit of a wait ahead of you. Take a look at Igor's List (link in my siggy) to get an idea of what's going on and who is being approved. Yes, you really have to wait until you hit the six month mark before you get your congresspeople involved. Only the US congressperson is helpful at this point, and if you call them before six months they will either tell you they can't help you or USCIS will tell them they can't do anything until you're beyond processing dates.

Thirdly: It will probably help when you get to the interview and you are trying to prove an on-going relationship, however bear in mind that when you hit that point the USC will have to prove that they make enough money to support you. That means 125% of the poverty level. Is his employer going to hold his job while he's gone? If not, make sure that you guys have someone in the US who is willing to co-sponsor you financially. There is a big set of paperwork they will need to fill out and they basically swear to be financially responsible for you for 10 years (I think it's 10...check out the guides for more details). I know there have been people on here who had someone promise to be a co-sponsor, then backed out when they actually read the paperwork. If you can not find a sponsor who makes 125% of poverty level, they will deny your visa at the interview stage.
