Hey, guys! I've tried to find topics here in the forum to answer my question but the ones that were kind of similar to my situation were from 2006 or 2007, so I was afraid they might need an update.

Well, my husband is preparing the documents for the affidavit of support (CR1 visa), so when we get our approval (hopefully soon) we'll be ready to go. The thing is: From the begining of 2007 until now, he is in a comfortable financial situation, that is above the poverty guidelines (enough to sponsor me). However, the tax transcripts of 2006 and 2005 show that he didn't make that much money since he was basically a college student living at the school dorms and stuff. So although he had a job he didn't meet the poverty guidelines those years. With the package we are also sending a letter from his employer that states his salary, how long he's been working there and so on. Plus the bank letter saying his average balance and stuff... We are going to send the 3 past years transcripts so we're afraid that even though he's been making enough money to sponsor me NVC might ask him for a co-sponsor. Do you think NVC will bother about 2006 and 2005 income? Or do they just want to confirm he was working and he filed the taxes?

Any opinion will be appreciated. ;)

From the I-864 instructions:

"You are only required to provide an IRS transcript of your Federal individual income taxreturn for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts for the three most recent years."

Including the letter from your employer is a good idea since it would establish that the income is not from a job that is temporary or seasonal.

There is no need to provide any Bank Statements, unless you are using assets to met the poverty guidelines. But even then, you have to provide "Bank statements covering the last 12 months, or a statement from an officer of the bank or other financial institution in which the sponsor has deposits, including deposit/withdrawal history for the last 12 months, and current balance". Plus, in order to qualify using assets, "the total net value of all assets must generally equal at least five times the difference between the sponsor’s total household income and the minimum income requirement for the current year".

Hope that helps. Good luck!

just to be on a safe side...just send the most recent year tax return...if that would suffice the poverty line, i dont think NVC will bother to see the other two years...if they ask for the past two years then give it to them...its better to play the game safe then start a new trouble...basically give them everything by the books, nothing less nothing more...hope i am making sense..
