Divorce question

My best friend filed for divorce 2 years ago.Every time it was time to go to court,his wife was always sick or just didn't show up.This case has been postponed 5 times and the court just dismissed the case today.His lawyer told him just to stay married to her and in another year they will be automatically divorced.This sounds weird.

There is no such thing as an automatic divorce. If you file and the respondant doesn't contest you can get an uncontested divorce. Hopefully that is what is happening. But until you have those final papers in your hand you are still married.

That's what I thought.So why did the lawyer tell him to stay married to her.She's trying to sue him for half of his pension and disability insurance.She basically just used him to get a green card but since he can't prove that,he just wants to divorce her.

I bet he wishes America had Sharia law. Men wouldn't have these problems!

Usually short term marriages do not result in splitting 50 50 especially if he has substantial assets entering into marriage. Usually a good lawyer will offer a fair 50 % of the assets aquired during the union and a limited alimony.

I did not go to court when I was divorced. They got along just fine without me!!

My not being there had no bearing.

She is gone, and I am happier than I have been all my life!!!!!
