Thank you for taking the time to read my posts....

Some may already know my husband has been granted a work visa and residency in another country outside of the one we are filing the petition through. I just found out today that he is not allowed to leave his working country (Spain)to return to his home country (Morocco)until after the 1st of December if he wishes to be able to return to work in Spain.

Given the timelines, we put in his I130 in May and I129f in June, should I be concerned that his interview might be before the 1st of December?? and if so can I refuse the k3 and go CR1 to bide us some time????

I know this is a shot in the dark but was hoping to get some feeling from my VJ peers.

I'd check the California processing time for the I-130. There are some historical processing times data here at VJ. It looks like it's about 100+ days processing from NOA1 to NOA2 if you filed in May. That means you might get your NOA2 as early as September? (Wow, that seems quick.)

My I-129F for fiancee took roughly 5 months before I got NOA2 (approval) then another 3 months before we had interview.

If the I-130 has a similar process, you receive a packet 3 from the embassy that has some paperwork to be filled out and returned before they'll schedule the interview. You may be able to wait a bit before responding to the packet 3 which would delay the interview date.

For us, it took almost 3 months between sending in our packet 3 forms before we had our interview, but we were going through Ho Chi Minh City, Vietnam, which is a busy consulate.

I'm not too sure about the I-130 process, tho.

Well, if you need to wait anyway, After they are both approved, they will most likely both be sent to the NVC. Just ignore the K3 packet 3 and go for the CR1. Just complete the process for the CR1 and see when they give you the interview date. If it is too soon, you can call or e-mail the embassy and get the interview re-scheduled. If the approval happens real soon, just drag your feet getting through the NVC.

But on the other hand, If he is leaving Spain to go to the interview, why does he want to return to Spain anyway? Wouldn't he just come to the US?

The reason is a couple

1. sometimes it takes months after interview to get the visa is it called AP???

2. He worries cause we are muslim that the U.S. will take a long time or worse refuse.

So if he has to wait he doesn't want to wait around not working, if he has a chance at a job and a chance we can build a future in Spain than he is getting things ready for the other options.

not sure if that makes sense but I asked the same. He worries that if he goes back too early and burns his bridges to go to Spain and gets stuck in Morocco he'll be without work and then can't send for me that way. But if necessary I can transfer my job to Spain and we can live there. (worst case scenario) we should be prepared.

Not sure if that makes sense but I know now I'll have to wait until then. :(

Has he looked into if there is a way to get permision to travel, kind of like you do if you get a K1 visa?

I say cross that bridge when you come to it :-) You just can't plan too far ahead with this crazy process...especially when it comes to determining date prior to approval (cause that we don't any control over)...but once we get that then we can control subsequent steps in the process.

Also, have you thought about him getting a tourist visa to visit you here? Seems he has strong enough ties to Spain and might have a good chance in getting one. :-)

update.... he can't get a "visa" to go to morocco until he gets his card from Spain in December. He applied for residancy for Spain and has to wait until then for his card to visit Morocco and be able to come back.

But like LuLu said... no point in worrying about anything until the time is closer.
