Hello Vjers,

My husband and I have an interview on the 22nd of this month, his medical expires on the 21st the day before the interview. I have to tell you that he entered on a k-1. the medical is good for a year. Unfortunately, it will be expired before the interview. I was just talking to someone from immigration, I was told that We have to get a new medical just to be in the safe side. Please, I need your help. Since you've been down the road before. Let me know what you think.

Another question: The affidavit of support, we submitted it with the application. the interview letter stating that we should bring it unless we've already done so. At the same time they ask for most recent tax return, employment letter, and paystubs for the last 2 months as supporting documents.

My question is: Do we really have to submit a new one just because of the employer letter, paystubs and the most recent tax return?

The application was sent in October, therefore I had to send 2007 tax return.

I'm confused. Please help me

07-18-08 Interview cancellation notice. Sigh---

I don't know if the rules have changed, but I believe the one-year expiration is in regards to getting it to USCIS within the year. My husband had his medical in the UK December 2006 and just had his interview today. The interviewer asked if he had it done overseas, saw the vaccination supplement in our packet and had no further questions. Unless someone has anything else to say, I wouldn't get it done prior to the interview and see what they have to say.

As far as that I-864 goes, I would complete a new copy with new information and include your 2007 tax return and W-2 and an updated employer letter. It shouldn't take you long to complete since not much has changed, but they will ask for this year's tax return and W-2 and may ask for a new I-864.

I believe the medical date that you compare to is 1 year from application submission not interview.
