hi there, how are you ??

i was wondering if anyone could help me, im a little confused!

we are doing the K1 option and i was thinking of visitng my fiancee while it is being processed ... what i am confused about is when should i be back in my country ( england) to do the next part of the visa after NOA2

i want to go for thanksgiving and christmas so we are trying to plan around this time! i looked and it said that if we send the I129f to VSC on the 1 aug or 1 sept it could be adjudicated by november 12 or december 7th,,,

so how soon after these dates would i be needed back in my native country!! because if it is soon after these dates we will send later on in the year !

Any help would be great!

also the divorce decree and birth cerificates??? can they just be photocopies of the originals for the I129f and i take the originals to the interview!!

You are only needed in your country for the interview, the medical and to obtain the police reports. I would suggest looking at the timelines for your country in order to guestimate how quickly after receiving the NOA2 that your interview could be scheduled.

My fiance is in Brazil and his interview was scheduled approximately 3 months after the approval. It just depends on the country.

Once you get the NOA2, you can call the NVC to find out when it gets sent to the UK. It's then going to be another week or so till you get packet 3. Most of the stuff in packet 3 you can find online. Just have a trusted family member send you the packet if it arrives before you get back.

Hi...we have similar situations so here's my example. We got Packet 3 from the Embassy in London about 3 weeks after the approval (NOA2) in Vermont. We got the appointment letter (Packet 4) about 3 weeks after we sent the checklist and documents back. You don't have to return the information the day Packet 3 arrives. Some people take a month. You have a lot of control of the timeline once London gets your approved petition from the USCIS phase. So if you want to enjoy Thanksgiving and Christmas in the US, then no worries, but your eventual visa will be slower if you delay sending back the info asap. You can do all the forms online while in the US. They are all filled in online and then printed to be mailed to London in the post. There is talk of new forms that are electronically submitted, but that hasn't happened yet.

I would suggest that before you go to the US that you get your police certificate. You have to have photos to send in and they have to be signed on the back by someone who has known you for at least two years. There's a long list of "official people" who can sign to verify your picture and your Mum isn't one of them. Getting that part done would be easier while in the UK. The certificate is good for one year. Also if the UK person is divorced, the instructions say to have a copy of your marriage certificate (to the ex) as well as the decree absolute. Don't ask me why, but it says that and if you want to cover your bases, then get a copy ordered. The instructions clearly say "even if divorced or separated." Seems weird, but we did it to be thorough.

The real ones go to the interview with you in case they want to see them in person. don't know if they ask for those, but you are informed to have the real ones in case they do. Take more copies of those to the interview in case they should want to keep a copy, so you don't have to give up your real one. UK birth certificate copy doesn't go in with the original I-129F submission, only for the London Embassy. The US citizen is sending in the US birth certificate at first to prove he/she is a citizen and has the right to petition for her fiance amonst other proofs like meeting in person, etc. Once all that has been approved, the the UK person has more proof of their worth to London Embassy....medical, police certificate, more biographical info, etc.

So get your UK official documents lined out before heading to the USA and you will be ready once you get the NOA2.

That bit about the marriage certificate is between you and London, so won't apply to you since you weren't married before. The forms you send staight to London are all about you and where you've live, and when you've visited outside the country, etc. Once the case crosses the pond she will only provide an I-134 Affidavit of Support to show she can afford you. :) Otherwise the ball is in your court to finish out the process and prove your eligibility. (Not a convicted criminal or terrorist, not mentally ill, free of bad diseases that aren't under control, not already married...those kinds of things)

She will only need her divorce decree (just a copy) to send to the USCIS with her I-129F Petition for Fiance. That is her proof that she is free to marry, just like her birth certificate (just a copy) is her proof that she's a US citizen.

If I didn't say it already, read the GUIDES and the FAQ under the blue tabs at the top of this page. Read every little link because there's a flowchart, sample forms filled out to look at, example of a cover letter, how to assemble the packet for mailing, list of everything to put in the initial packet. It's your best source of information. The forum is good for extra help when you're stuck or need support, but the most important information you can gain is up there. Do your homework and you'll get through the process much faster without unnecessary delays because you'll do it right the first time.
