I-90 Info thread for Greencard errors

LOL maybe its me that is confused. I entered on my CR1, yes, and have my greencard valid for two years.....but I was under the impression that after two years I'd have to go do an interview to become a permanant resident. Right now, its no big deal that the card is in my maiden name, I have my SS#, my drivers license and my military ID in my married name. My passport is also in my maiden name. So I'm just wondering if I should wait it out or if I should just go ahead and have the error corrected. Am I right in thinking that I will have to send back the card with the error on it when I file the I-90?

You do not have to file for AOS when your Greencard expires you have to file for Removal of conditions... I-751 you have already had your interview to get your CR-1...

I would get your Greencard fixed as soon as you can... and yes you would have to send it back, if you need it to travel this summer you can get a I-551 in your passport to allow travel and work....

I was under the impression that after two years I'd have to go do an interview to become a permanant resident.

I had a co-worker who entered with a CR1 and she just recently filed for removals. She never had an interview, per say (sp?). She received a letter asking her to make an Infopass appointment where she would have biometrics done (I think). But they never actually sat her and her husband down or anything, ie no interview. This may not be the same for you (as you know USCIS is never consistent), but it means your chances of not having an interview are very likely. I don't know if (it were the same in your case) you'd have a chance to let them know about your name when you'd go for biometrics. So I don't know! I guess it's up to you to determine when the right time is to attempt to fix it.

Any news, Steffi?

I have an Infopass appointment for tomorrow morning as my Europe vacation is coming up and I need another stamp. It would be soooo much less of a waste of time for them and me if they could just give me a one-year I-551 stamp while I wait for the replacement. That way I wouldn't waste a space in line when other people need to be there, plus I wouldn't have to take time off work. But I guess USCIS never likes to take the easy route. I'm very frustrated and I can't believe it's still going on. Especially when I hear of people getting AOS interview dates less than 3 months after they sent off their application. *steaming*

So yes, no news since I sent my stuff off (For what? The 3rd time?!).

Yeah, I really feel a "little" screwed over with this whole process. From start to well....I wish I could say finish, but I guess I can't even say that!!

I have to get to class but am anxious to get back and read all your posts. I did get a hold of the USCIS finally this morning so we will have to get all our stuff together to prove I am not a man now. In filling out the chart here, is the Missouri service center's code MSC? I will fill in more once I have more.. this headache is all just starting for us.

Yeah, MSC, NBC - same difference I guess, haha. (MSC = Missouri Service Center, NBC = National Benefits center)

----------------------------------------------------------------------------------

Here's my update...

Well, it’s been over 6 months since I sent off the first I-90 and to this day no word on a replacement Green Card. As I’m leaving to go to Europe in a week and a half and my last stamp isn’t valid once I get back I needed to get an extension, so I made an Infopass appointment for this morning.

Just a quick reminder of what’s happened up until now:

- Was approved without interview through CSC on November 10, 2005

- GC arrived with another woman’s photo on November 14, 2005

- Left for Europe November 16, the same day I struggled 3 hours to get I-551 stamp in my passport so I could return hassle free (stamp was made one day longer than my trip – ack!)

- Filed I-90 when I got back from Europe, including original card, explanation of what happened, etc

- Received RFE to send in passport photos, sent those in, got email confirmation saying they received passport photos

- March I received the entire I-90 package back (incl. original GC) saying my photos were never received and my file was now closed

- Made Infopass appointment, received 3-month I-155 stamp and was told to re-file I-90 from scratch sending photos, letter of explanation, but not original card

- Received RFE for original GC, passport photos, and letter of explanation…sent everything in and no heard no word since April

The wait in line was fortunately very short. Probably not even 5 minutes in the reception area and then about 5 minutes to be called to the counter to speak to the immigration officer. The lady was very nice and we explained all the complicated things that have happened to me since the arrival of the faulty GC and that I needed to get an extension on my I-551 stamp so that I could go to Europe. She looked through a bunch of papers with all the different dates of when I received RFE letters, when I returned stuff to them, etc, etc. But the last thing she said showed up in her compute was the RFE in October 2005 before I received my Green Card (which had asked for updated financial records and a translation of my German birth certificate). She said there was NO record of my I-90 package from April ever having arrived. Very worrying to us!! After all, that package included the original GC. She told us that sometimes it takes time for these things to show up in the system, so she said she’d give me the I-551 stamp through December, and if we hadn’t heard anything by December to come back and talk to them and look into starting an “investigation” (I suppose?) into my case and what on earth is going on with it. As we were still chatting with her she got confused and made my I-551 stamp until June 2007! Yay. The first mistake that was in my favor, haha. She realized she had made the mistake and pretty much said “oh well” and said we should still come back in December if there’s been no word on my file.

So at least we left with some relief of finally having a stamp for a year (now why couldn’t they have done that in the first place back in November 2005??) and the joy of not having to return every few months to get a new stamp. So now we have a little bit of time to get this resolved. My hope of that replacement card arriving by December and next to none. I think there is something very, very screwed up with my file. What it is I of course don’t know. But it seems to me that somehow things obviously aren’t connecting. Somehow every time I send in my RFE’s they don’t get connected with my file because of whatever disconnection reason. Therefore I don’t think I’ll ever get that card. Not until someone starts some process to figure it out.

Patrick and I decided to contact our senator again when we get back from Europe and see if we can get serious about this and hope that he can get something resolved. This has just gone on way too long and whatever is wrong needs to be fixed, bad. Hell, I’ll get my citizenship before this Green card issue ever gets resolved! And why do I get this feeling that my original GC is now lost forever and I will get blamed for loosing it and end up having to pay for their mistake? I can just feel it coming.

So that’s my update! *sigh*

Steffi Congrats on the 1 years stamp... sorry to hear the saga goes on for you too... I would get back intouch with your congressman when you get back....

Have a wonderful trip ....

Kezzie

Yeah, that's the plan. And thank you! At least the 1-year stamp will take care of any stress about future travel or emergency travel for a little while. Though it looks like my fight will be far from over and I "can't wait" to see what all lies ahead to try and get this mess sorted out (since I don't forsee the Green Card magically appearing on it's own).
