F-1 applying for AOS

Hi everyone, ... I entered the U.S. in 2004 from Dublin, Ireland on an F-1 visa. I met my husband in 2006, June in Economics class (hahaha he wanted to be my study partner.. so cute!!). We found out were are to become parents in Jan 2008 and got married June 20th 2008. I am so worried as my daughter is due in August and I have to take classes as I don't want to loose my F-1 status. I am hoping that if I get my I-130/I-485 combined packages sent July 21st I will be approved before the end of Dec 2008 and hopefully be able drop two classes without having to damage my record... Its just scary how expensive international student rates are especially with a baby on the way!! yikes!!Anyway I have so many questions and would love to chat with someone that perhaps has a similar case to ours??

We both live together and have done so for the past 1year and a half however we have not updated our driving licenses do we need to include copies of our DL in our application? or would a lease suffice, bills etc??

Also what exactly is a certified copy of marriage license? I Have been researching constantly and therefore held onto the license when we wed on the 20th (as recommended in the guidelines on visa journey!)... I will be bringing the license into the county clerk so they can put it on file. Is this also where I may obtain a certified copy??

Your lease and bills should be fine (not everyone has a DL so its not required. Update it when you get a chance). Yes, the county clerk is where you get your certified copy.

Also, you should visit the AOS section in the forums, there is a sub section on adjustments from non-marriage based visa. Thought I'd mention it if you hadn't found it.

Yes, that's where you can get the certified copy, @ the county clerk.

I also adjusted from an F-1, came on 2000, graduated, applied for OPT and filed for AOS on 2007. See my signature for a better idea. Honestly since I didn't get married until I graduated, I really don't know what the deal is going to be, remember that in the moment you file for AOS, you stop being a student and become a foreign spouse waiting to adjust status. You are in a legal limbo that lets you work (EAD), stay in the US and even exit and come back to the states (AP) legally until you receive your green card. What I'm sure about is the fact that you can apply for instate tuition and even federal loans until you have your green card in your hands. Check with your international advisor to know for sure what is the way to go w/this transition.

once you file AOS (filing the I-485) you are eligible for instate tuition fee. Some private institutions may argue that until you are proven resident you are not. It's a grey area but check with your school and do some research in regards to residency requirements in your state. Also once you file your status will be "AOS pending" and you no longer require to maintain your F-1 status. This means you don't need to sign up for 12 credit hours and you can do courses online. I filed in June and sent a copy of everything instead of originals or certified versions. Just make sure when you go to the interview you have the originals of everything you sent with you or you may face delays. You don't need drivers licenses included, I found a great website as to how to file your I-130 and I-485 so let me give you the link. www.frenchlolie.com/en; I hope this will help good luck with your application.
