Hello all,

My mother-in-law is here visiting on a B2 visa. She has a visa to the US and Canada (she has a son that lives in Montreal)...so here is the situation....she flew in 6/25/08 and is staying with us until 7/31/08. At that time we will drive her up to Montreal and she will stay with her other son until 9/6/08. She will then come back to our house and fly home to Algiers on 9/16/08. The problem that we just discovered is that her US Visa expires on 8/4/08. We thought is was good for 6 months, but turns out it is only good for 3 months. Her I-94 (little white card that is stapled to your passport when entering the country) expires 12/23/08.

So my here are my thoughts....she can stay in the US until 12/23/08, but she can't reenter from Canada after 8/4/08...does that seem right? I spent all morning on the phone trying to figure this out but I could not get a straight answer. Does anyone know if we can get her visa extended? I would like to stick to our original plan if at all possible. Any suggestions at all would be greatly appreciated.

5/31/07 - Biometric Appointment

6/3/07 - AOS/EAD Touched

6/28/07 - AOS Transfered to CSC

7/7/07 - AOS Touched

7/20/07 - EAD Approved!

12/5/07 - AOS Touched

12/12/07 - AOS Touched

12/18/07 - AOS Touched

12/19/07 - AOS Touched

12/20/07 - Card Ordered

Removal of Conditions (ROC)

10/9/09 - Mailed I-751

10/19/09 - NOA1 received for ROC

sounds like it is a single entry visa. She had to enter before it expired, but once she did, she can stay until 12/23. If she leaves she cannot re-enter.

When does her visa to enter Canada expire??

She can probable transit the US again to make her connecting flight, but it sounds like the easiest, and expensive, is to return from Canada to her home country.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Somebody at the airport port of entry must have been asleep. When I was dating my wife, they didn't give her very much time on the I-94, called my immigration attorney and he filed a form to extend that here in the USA, but her visa was good for another five years.

I guess your problem is extending her visa here, if there is a form for that, I never looked, never had to, but if I were in your shoes, would be contacting my immigration attorney again and asking him or go crazy trying to find the form to fill out, if there is even one.

So you are hoping someone on this board that extended a visa here in the USA for a person from Algiers that can tell you exactly what to do if anything can be done about it here.

Could be lucky, or just contact an immigration attorney.

She could try and get a Visa from the US Consulate in Canada. Usually Consulates will only deal with residents.

Easiest would be to fly home direct from Canada.
