No I am waiting to file to see if i am going to deploy again I dont want to screw up the timing stuff cause of that.

How can that scew up the timing, do you have to be with her at every step of the process, interview etc? Im USCG and I deploy too but only for 2 months at a time.

Well to do a presumptive death they sent a notice to his last known address and she had to do a statement or something that said she hasnt heard from him in over 2 years and what not. The judge was very nice and was like she shouldnt have to pay for the mistakes like this, if you get a good enough lawyer and stuff the court period only takes like a month then it takes like a month or so to get them to update the database. I think that would of took longer if my fiancess didnt bug the heck out of them. But the lawyer and everything ran about 1200.

Yes I know its fraud I got yelled at by my fiancee when it came up too!! Like when we were first doing it all I thought it was going to be easy cause she thought she was divorced in america (He sent her bogus papers 2 years before). So when we figured that out, I was so mad I was like screw it lets just chance it. Well my fiancee straightened me out and we submit everything that was legit! NEVER EVER LIE ON THE PAPERS. NEVER EVER!

When I said that before I was just curious if anyone tried it so I could rub it in my fiancees face that it would of worked......But I was wrong (she makes me say that) She was right!

How'd you end up finding out it was bogus?

When she showed me them they werent even signed by a lawyer and not notarized.

maybe someone has asked u this before but did u contact the court where the bogus papers were made out to see if they maybe got put thru? cuz many times the person that is in another country does not get copies of the final decree at least from what i have seen.......might be worth paying that online thing to see if anything was done with them u might not have a problem at all.........

It sucks but the way to do it is annulment. I am assuming they were married in Filipines. It must be filed where she lives and will cost around $2000 and take anywhere from 6 months to 18months without major problems. Hire an attourney that practices Family law. They will have to establish psychological reasons the marriage was not valid as the easiest way so expect that psycholgist fees will be part of the lawyer fees. My fiancee and I are 13 months into both our engagement and her anullment. I do not even dare go for a visit waiting for the decision so we can finally file for visa. Do check and see if the marriage is recorded for sure. If it is not you just hit the lottery, because if it's not, it's not legal and you are not lying when you say she is single because under the law she is. In short you can't annul what isn't recorded. Best of Luck.

Well i have to disagree with the highlighted part,it's not always the case that if ever she has no record it would mean that she's free or single.there are some cases that the marriage wasnt recorded at nso but when u go and check it at their local registry office,it's there and it's recorded.also,US embassy has their own way of finding out.

Ok here is the way i fixed it. Ok the divorce papers were not BS the State of Oregon just didnt send Mhay the right thing. The state sent her a copy of the papers before the judge signed them and notarized them. So everyone thought they were bogus (me mhay and the lawyer in the phils) well on a hunch I went to vitalcheck.com and sure enough I was able to get a copy of the decree. Which is like a "duh" moment why didnt we think about that a year ago?

ANYWAY the reason for the hunch! Ok so when my fiancee filed the annulement stuff (presumptive death) there after she aint heard from the guy for 2 years, somehow, someway, (Mhay told EVERYONE)....the guy finds out and gets worried about the presumptive death filing cause he thinks it will bar him from ever coming to the phils again so he tries to hire a lawyer there to block it blah blah blah and then it comes out he is trying to marry another girl there (she should really get with mhay before she does) so thats when I think maybe he really did file and sure enough he did....Its like a soap opera!

But we are just waiting for the process to be done the judge signed off on it all we are just waiting for it to be out of the database now before we file.

I figured out that if i deploy I can get granted and extension on the visa.

This is why I am curious to see if anyone elses fiancee had a previous divorce from the states did they use the date it was filed here or there on the 129.

2-24-08 I come back from Iraq safe and sound cause I promised I would!

3-25-08 Fly to Manila AGAIN 3rd time on that flight (But it was a little better on Continetal Airlines to Japan cause there coach class has power ports for laptops.

4-22-08 End of the best month ever....even though I had to shower from a bucket like Iraq and buy her an AC cause I was dying at her house....Had to do the visa extension thing which was easy, I had a very good time for the month I was there and felt so much more comfortable about the future!

Good question and I don't know the answer, although I think it would better to use the date over there, (in the phils) couldn't do any harm that way, because if you put the date that it was filed here they may not consider it valid, but again I don't for sure. So does the decree that you got on vitalcheck.com, is that considered valid? Does it not have to an original document thats notarized etc?

My fiancee was married before to an american, it was a long time ago (4yrs). They never officially got divorced and he returned to the US. She has been unable to find where he is, now this is holding up our application. She is looking into annullment, does anyone have any experience with this and if so, how much more difficult does this make our application. Will they hold her first marriage against us? Will it look like she is just trying to get into the US seeing that her first husband also was American?

Last I knew from a friend's experience, an annulment in the Phils cost about $5,000 including legal fee, and could be granted in about six months, best-case. In that case, the former husband was somewhere in Thailand and was reportedly remarried...but no documentation was available. Divorce is not recognized in the Phils, but a divorce granted to her former husband in a U.S. state would be acceptable to the U.S.C.I.S. Was the marriage a civil one, not in any church? I know of one case where a Phils civil marriage was simply dissolved by the office that performed it.

She had a civil marriage. The whole thing seems pretty silly if you ask me!
