hi! weve got the same situation. i had my interview last may 23, 2008 and until now my fiance is still processing of our documents. hopefully on monday i will send it to the embassy.... our situation was, my fiance is not working right now because he is under medication that is why the consul ask me to submit evidence of current sustained income. as of now, weve got the papers they need and i will froward it to the embassy soon..... if her fiance is not working or his fiance's income is insufficient the embassy will surely ask or question about it.... i hope it helps.. tnx.

Asking for evidence of sustained income means proof that he is working and making an amount over the poverty guidelines. It's hard to say what the problem is with this limited information. She had an affidavit of support, but did she also have a copy of his income tax return for 2007? Did she provide a letter from his employer stating his current status with his present job? Did she provide copies of recent pay stubs?

If her husband is not working now, or is making under the poverty guideline amount, then they will need a co-sponsor. Otherwise, I would say she needs to submit all of the proof mentioned above (tax return, employment letter, and pay stubs) to show he makes enough money on a consistent basis to support her so she will not become a public charge. If he is self-employed or not employed and only relying on his assets as a basis of being able to support her, there are different requirements and I am not really familiar with them.

I don't know if it was your assumption that she did not want to go to the USA or if that was what she told you in her own words, but if that is truly how she feels then I agree with the earlier post. Why did she even attend the interview? Tell her to contact the embassy and tell them she no longer wants to proceed with her K-3 application. She then needs to tell her husband too.

Just my two cents here.....

(she dont really want to go to US daw!) ano kaya eto?? anybody who have any idea? or have the same situation???

Why did she come for the interview?

that's my question too aside from that why bother helping her if she even admitted that she don't wanna go to US? << i didn't say that in mataray tone :) kaya lang i am wondering kung bakit she went to her interview then she will say she don't wanna go to US.

Hi, I got the same situation except I also have to prove my husband domicile because he lives here in PI for five years so he needs to go back to US to re-establish his domicile. Anyway, my hubby is a retired navy and we passed the poverty line but still he needs to submit evidence of sustained income which pissed him off and me too, he served the Navy before and now that he is retired and enjoying life, he needs to work again to provide evidence of sustained income... <_<

Isn't that part of NVC process, when you send the DS-230 with I-864? I thought if your I-864 is ok with income level then it is part of being approved at NVC then your able to go on to a interview? So why then at interview they ask again for income proof when that is the job of the NVC ?

That's what my husband said also. It drives us crazy thinking why they did that.

Hey Hanny,

Kapag sa nurse mejo doubt cla kace they think na fake relationship, coz its a common knowledge to everyone na in-demand ang nurses sa US, kaya they ask for more additional evidences.

If ayaw nya magpunta sa US, bakit kamo cya nag attend pa sa interview? LOl!

Anyway, musta na ba mga berks? ;)
