I-864 If Amer. Fiance lives at parents home?

Hi there,

We are trying to fill out the I-864 in order to file the AOS. My fiance has lived with her parents for the past two or so years, and we are moving at the end of the week, but is her father supposed to claim her as a partial dependent? How are we supposed to fill this out on the form? Is he supposed to fill out the I-864A? And her father is the only one earning an income other than my fiance, so is she supposed to include her siblings and mother in the household size/should the total income be both my fiances and her fathers on both forms? And is it supposed to be the new household that we are moving to, since that will be the current household we will be living in when they receive the form? Or would it be the household that she spent more than half the year in (similar to tax filing for dependency)? And, last bit, she has not been declared as a dependent on their taxes for the past 3 years, and she is now 25. And as a side note, do we need to file the AR-11 at the same time as we mail in the AOS, because the address won't be the same as when we originally filed? Or is it not necessary, as we will be putting tat in as our new address in these forms?

Since they will no longer be a part of the same household a week from now, I'd say each would fill out an I-864. Show only their own income on each one and provide separate and complete supporting documentation. Remember, if the income is sufficient, all questions related to assets can simply be left blank.

They care about what she is making 'now' ..not what she made three years ago.

Not quite. In theory, yes. My wife was a college student, who had gone to work. Her most recent tax return was above the threshold but the previous two years weren't. We had her mother co-sponsor. Would they have said "no"? I don't know, but the case officer /did/ note it and ask. They want to see a reasonably steady stream of support.
