Hi eveybody, this is my 2nd post on this website, which i find very helpful. I found some really useful information in it. keep up the good work. I asked this question before, and i really need help regarding this matter. I filed an I-130 in April 24th, 2008 at the vermont service center, and the check was cashed. I never received the notice, however. when i contacted the national customer service number, i managed to get the receipt number, and saw online that it was received on may 1st.

Now the problem I am having is that they told me that i cant file the 129-F witout that notice, and i must wait until i get it or else my application will be significantly delayed. they said that they put in a request for me to resend the notice, but i dont really know if they're telling the truth. I have been waiting for a month now and still didn't get it. Is this true or can i file the I-129f (K-3) and send them the EAC # with my application ??

By the way, it took me forever to reach a human being on that customer service number, the people are rude, don't know what they are talking about, and can't wait to tell you that they are subcontracted to answer the phones, and they do not work for the USCIS. I called them june 12th requesting that they either mail or email that notice to me, but they said they will put in a request. called them again july 2nd, they said that i have to wait till July 12 to inquire about the same problem, and if i dont receive the letter, i have to wait 60 days from my first phone call to make an additional request regarding the same problem. thats just stupid beyond anybody's imagination. if u ask me, i think they r doin' that on purpose because of the backlog they have. i wouldnt be surprised if they intentionally didnt ssend the notice to me !!!!

please tell me what u think, i want my wife here as soon as possible, but they are holding me up and gettin on my nerves

I think you should fill in your timeline and you will get alot more responses, just put the info that you already know about your timeline. your next question might be how long does something take. and if the timelines aren't filled in it wouldn't be possible to predict... I believe all they need for the I129F is the reciept num

Wow, that really sucks! Not sure if it would work, but if you are registered on their website:

https://egov.uscis.gov/cris/jsps/index.jsp

I would probably print out a copy of everything (webpage showing number, a copy of your cancelled check, and any other pertinent information from you I-130 filing) , explain you are waiting for the replacement copy, and submit the I-129F. If they reject it, you have lost very little as the filing fee is waived if you already submitted a I-130.

Not to dishearten you, but when I got Rin's NOA2 for her I130 the USCIS had misspelled her first name (it was correct on the I129F and both NOA1's). They told me they would change it. That was February 2007. I finally got a followup NOA from them in August 2007 stating they could not change it as my case had been forwarded to NVC, so I would need to contact NVC and have it corrected (by that time Rin had her visa and had been in the US four months). Of course, I had already called NVC in February and was told it didn't matter as they used the information from the petition I had completed, not the form from USCIS.

Also, at this point you are more than two months into the I-130 process headed for a CR-1. I would be concerned that the I-129F might not "catch up" to the I-130 and get approved ahead of or at the same time. If the USCIS takes another month or two to mail your NOA1, your I-130 may very well be approved before you get the I-130 NOA1.

Thanks john for your help. I did have an online account that shows my EAC#. when i mentioned your idea to them, they gave me the same answer !!! but ur right, they r so slow, and i would probably wait for a few month before i get that notice. i will try to call'em again in a week and see if there is anything new
