We just had our first child on July 4th. We have already sent in the I751 form and my wife has had her biometrics done. Do we have to send in any other forms. What should we do.

First... Congratulations on your baby...

As for what comes next all you can do is wait.... I would suggest you use your Application Number and set-up your case with the USCIS so you can know when they have "touched" aka worked on your case and also if you provide them with an e-mail they will e-mail you to advise you of the status.

For what possible purpose are you thinking you might need to submit additional forms for? Birth of a child?

I'd make an Infopass appointment and show them the BC of your child. Mainly because having a child is solid evidence of a bona fide marriage. May assist in you guys not having to have a interview.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

This is terrible advice. Doesn't making an infopass appointment to show them BC of the child defeat the purpose of not having to hassle yourself if they ask you to come in for an interview? Besides, the person at the info pass appointment is not the person who will be adjudicating your case anyway.

Look, at this point this is what is going to happen: they will either approve you, ask you for an interview or send you a letter to ask for more evidence (known as an RFE). The chances of an interview or RFE are slim, and no matter what you do at this point they won't get to your case any faster. Having a child will make it easier to provide more evidence if that slim chance of RFE or interview arises, but right now there is nothing you can do to speed up your case so just relax and spend time with your child - congratulations!

If the baby was born in the USA, it is a US citizen by birth, the I-751 only covers kids that came here with their parent and likewise received a consitional residence. But you can sent in a copy of your new baby's birth certificate, darn good evidence you just didn't marry to bring in an alien. And that is the key purpose of the I-751, did you use marriage just to bring in an alien? Of course you are guilty of that, we all are, and it's up to prove to the USCIS we didn't. Kind of conflicts with the US Constitution on this subject that applies chiefly to the USC that can be tried fined, and tossed in jail if you cannot prove your innocence. The alien is just deported, but do believe the USCIS has to prove that in a court of law. We just sent in tons of evidence, no problems and did get our ten year PERMANENT green cards. Guess permanent means either two or ten years.

Congratulations! I would just wait ...for approval, FRE or interview. (if I can imagine how gov agency works...) When you send any additional doc for your file, it disrupts normal procedure (they have to fish your folder, stick in new papers, touch it up, etc-are you sure they are going to put folder back onto right shelf?). I really doubt that this disruption is helping. But if you get RFE-that is a good doc to send.

Thank you all for the advice, I think it will be easier to just wait it out. In the event they do ask for additional evidence, we will just send in the birth certificate of our child.

Work the other way for us,

Send a letter to California once it was verified our application was transferred there.

Dear Sirs:

On the basis that the evidence we originally attached to our I-751 is now well over a year old, enclosing both our 2006 and 2007 joint tax returns, a photo and the AKC registration of our German Shepherd puppy, and photos of us taken Christmas of 2007. If you require any addition evidence, please let us know.

Warmest regards,

Nick and Gloria.

Ten days later we received our green cards.

My way of saying, "what is taking you so long." Other applicants in our time frame were making infopass appointments already and was just about ready to do that as we were renewing my wife's and daughter foreign passports. Maybe this letter saved us another 420 mile trip.

Maybe timing was right in your case (and your file was in from of the reviewer). Or maybe you were approved already since it takes a couple of weeks from review to getting actual cards. When your case was touched the last time? Have you got actual cards in 10 days after sending new info? (in this case, I would say that you were approved before they got new docs). Please let know-very currious to know how they work.
