is there any timeline or deadline between the time you marry to the time you send in the i-485 form for adjustment to a permenent resident ? uscis said no, but i wanted to make sure. her visa runs out sometime in june, but we are married and we did not surpass the 90 day timeframe between the time she entered the U.S. and when we got married.

just want to make sure there is no deadline date between getting married and sending in the i-485. if not i think we may just send in the i-765 for now so that she can work legally.

I was a few days late getting my application in, no problem.

But do it as soon as you can.

EAD is dependent on I 485 being submitted..

EAD is dependent on I 485 being submitted..

Yip, you can't apply for the EAD without a pending I-485 (AOS).

A few VJers have gone over the 90 days without any penalties.

03.04.2009......Posted I-130 to U.S. Embassy

03.04.2009......Ordered Police Certificate for Visa Purposes from Local Garda Office (ordered over the phone)

03.05.2009......I-130 received at Embassy

03.06.2009......Received Police Cert

03.18.2009......I-130 Approved

09.10.2009......Medical Exam

09.23.2009......Embassy receives Notice of Readiness

10.13.2009......Received our interview date

10.29.2009......Successful interview!

11.5.2009........Visa received in post

11.7.2009........All the family flew to the US together :)

12.20.2009......Received Welcome to America letter

12.24.2009......10 year Greencard received in the mail

Like Boiler said, she won't be able to file I-765 without filing the I-785 first or at the same time as the I-765.

So if she wants to work, you had best file those sooner rather than later. :)

One more point in addition to what other posters have told you, when her visa runs out is not relevant to anything now that you're married.
