CR1 to IR1

Hi everyone,

i got CR1 visa at this month, and after few days 2 years of our wedding will be completed, i m moving to US In the next month. so can anybody tell me how can i will be getting IR1 .

If you enter the US with either kind of immigrant visa (CR-1 or IR-1) after your second wedding anniversary is past, then you will get an unconditional green card with no need to remove conditions. See INA 216 g 1 B.

It may be useful to remind the officer of this fact at the port of entry. It's not unheard of for an officer to not notice that the second anniversary has passed, make a clerical error, and issue a conditional green card in these circumstances. Maybe a polite way to raise the point is to ask, "Since my marriage is over two years old now, will I get a conditional or unconditional green card?"

Note that you don't need to get a new visa or anything; you just need to make sure that, when they process your paperwork at the port of entry, they note that your marriage is more than two years old.

Sorry to hear that you were just a few days away from 2nd annuversary. You could get IR. Now have to do I-751 in two years and pay all these fees and keep all docs to prove bona fide marriage. I just wonder, could you postpone the interview fro CR1? Have you spoken to a lawyer about timing?
