We just got our 1 year extension NOA for the 751 form. It says right in the letter conditional residents wont get the biometrics appointment and just supply the documents listed in the form instructions to complete biometric proccesing. I guess when we did biometrics the first time for the 2 year green card was good enough. Too bad I already sent the extra 80 bucks. I wonder if I'll ever get it back. When we travel do we use the NOA letter to show the green card is approved. Any help appreciated.

Hmm, that doesn't sound right. Since I never received the NOA extension letter I can't compare it, but I am pretty sure that it says that there will be a biometrics letter sent. The application requires a biometrics fee and the USCIS only keeps biometrics valid for 18 months. Would you type out exactly what it says on your extension letter? It sounds like it is a different letter than others have received and I am curious if this is a new direction now. I do know that I - and every other conditional resident that I know who has applied for the I-751 - have had to do biometrics.

The NOA extension letter is not an approval letter. It basically states that they have received your application and that your status is extended for one year while that application is being processed. You need to present the extension letter and the expired green card when returning to the US after traveling outside of the country.

I received the NOA for my I-751 application on March 21 this year and had to have biometrics taken on April 21 (notice date was April 4). I would be very surprised if you did not have to have biometrics taken again.

When did you get the NOA? It might just take a few weeks to get the bio notice.

O1 Visa ~

Jan 2000 - Job offer in US

Jan 2000 -O1 Visa application started

March 2000 - Entered US on tourist visa to check out new job

July 2000 - Return to Ireland to have Passport updated

July 2000 - Return to US with O1 visa valid for 2 years

Dec 2001 - Visa extended to Dec 2004

Nov 2002 - Met future Husband

April 2003 - Started Dating future husband

April 2004 - Married :)

AOS ~

Nov 2004 - I-485 received

Nov 2004 - I-130 received

Nov 2004 - I-765 received

Aug 2005 - Biometrics

Jan 2006 - Initial Interview

Jan 2006- I-765 received

March 2006 - Biometrics

April 2006 - Green Card issued for 2 years (Total 1.5 years)

Removal of Conditions ~

March 2008 - I-751 received

March 2008 - 1 year extension

April 2008 - Biometrics

July 5th, 2008 - Request for Evidence

Aug 4th, 2008 - Mailed RFE

Aug 11th, 2008 - :) Card production ordered

Aug 18th, 2008 - 10 year Card Received :)(Total 5 months)

Other stuff ~

Sep 26, 2008 - Form I-90 mailed for name change from maiden on GC

Sep 30, 2008 - Check cashed for $370

Oct 3, 2008 - NOA received

Oct 20, 2008 - Biometrics

Kathryn41 - you are correct- my wife received her biometrics letter today - at first she thought it was for her interview appointment - but when I told her to read it more carefully - she realized it was for her biometrics appointment only. (She had received her extension letter the prior week.) They add a lot of other additional information to the letter that doesn't apply and can mislead people, but about 1/3 to 2/5 of the way down - it clearly states it is for biometrics. *** too early in the morning for a three hour drive, but oh well! *** I am glad that it came so quickly - filed on June 17th. Now we will wait to see if we will need interview. Good luck to other filers!!! :thumbs:

I believe the OP may have read through the NOA1 letter rather quickly, and may have missed an earlier part of the letter which says that a biometrics appointment will be sent soon. A little bit later it says that those outside the US pursuant to government orders do not have to do the biometrics etc etc.

At least, that's my guess.

I did not receive an NOA extension letter but did receive a NOA biometrics letter...Should I have received an extension letter by now? I have a receipt date of 4/15/08. Could the letter be lost in the mail? How do I travel because her green card is expired now...Any help greatly appreciated.

Just make an info pass appointment and explain the situation and then get a stamp in the passport and you should be good to go. I would say the letter was loss or never sent. Either way they shouldn't have a problem with it.

here's the middle paragraph of the NOA, right after it says you will recieve a seperate ASC letter for the biometrics appointment.

"NOTE: Condtional resident applicants, including conditional dependents residing overseas pursuant to military or government orders WILL NOT RECEIVE and ASC appointment notice. To complete biometric processing, these applicants must submit the required items listed on the I=751 form instructions."

Sounds conflicting doesnt it. Maybe i'm not a conditional resident applicant. Further down it again talks about reciept of your ASC appointment and viewing the case status online. I guess the NOTE is just confusing

The grammar in the notice could be better, would be better written thus:

"Conditional resident applicants (including their dependents) residing overseas pursuant to ....."

Basically, you don't do biometrics if you're a conditional resident who is overseas because they are required to be as a US govt official/military personnel. All others do.

Yes, it is confusing. Basically, it is saying that if you are residing outside of the US you will not get a biometrics appointment but you do need to submit the passport photographs, etc. listed. The instructions on the actual application say the same. The sentence is poorly worded though and while it implies all conditional residents it actually means only conditional residents residing outside of the US - including those on military or government business:-) - not ALL conditional residents. Elsewhere in the letter it states that you will receive your ASC appointment - that is your biometrics -and that you won't be able to view your case status online until you receive that letter. They are trying to use one letter to cover a variety of situations and whoever wrote the letter has poor writing skills - and whoever approved the letter, also has poor writing skills:-).

So, expect to receive a biometrics letter soon.
