I just called USCIS customer service representative to withdraw our I-129F application pending for K-3 visa since we have CR1 on hand. I though I could do it over the phone. But, I was told they need something in writing. So, I am going to mail one to Vermont Service Center today...

How long of an inactivity? Mine is inactive since September 12, 2007. And I don't care about it anymore. What

happens if someone does not cancel it in writing ( besides it expiring by itself )?

A K-3 petition will expire on its own after a period of inactivity.

Thanks fwaguy (F)

That means, if somebody filed I-129F for K-3 visa and waiting for K-3 visa still. Suppose inactive period is 1 year, so will it be cancelled automatically and he/she won't get K-3 visa ??? Will USCIS refund the fee if they cancel it due to inactivity ? Just a thought

Funny guy. A K3 visa cannot be granted after your I-130 has reached the Consulate abroad and certainly not when you are already in the US with a CR1. Informing USCIS would be a courtesy to others in the process, so no more time will be spent on your case but there is no actual need to do anything about the petition or consequence to you for not withdrawing it.

FYI, may be useful...

I just called USCIS representative for the follow up of I-129F withdrawal letter I mailed 2 weeks back.

I was told that I-129F is automatically closed in April 2008 when our I-130 was approved. Then I asked why online still says "Pending". She told the online info. is wrong or not updated properly, but their records show that I-129F is closed in April 2008...

But still we need I-95, I-287, I-90 to get into Niagara Falls :star::star::star:
