question about the Affidavit of support and annotated birth certificate

my hubby (a natural-born filipino naturalized in the US) lived in the philippines for a year were we both worked in the same company.he went back to the US just right before he filed the petition. he just started on his new job. i was just wondering if we could provide a photocopy of the contract of employment or the job offer in lieu of a certificate of employment since it takes some time for the coe to be issued upon request. and does he really need at least 6 pay stubs for the affidavit of support? i was also wondering if we could provide photocopies of the irs transcripts, tax refunds and bank statements since we would both need two copies for the NVC (I-130) and Us Embassy in Manila (I-129f). his mom is his co-sponsor. does she also need to provide a photocopy of the deed of the house she owns where we will be living?

I noticed that the passport indicates the place of birth. My birth certificate was anotated recently to include the place of birth as mandaluyong (as required by the department of foreign affairs), since it originally indicates greenhills, metro manila in place of birth (although mandaluyong is written as the municipality where it was issued in the upper left hand corner). the annotated birth certificate is in security paper but i noticed it doesn't have the barcode like the original bc has. should i submit the original, the annotated or both to the Nvc?

2008-07-29: IMMUNIZATION

INTERVIEW: 2008-08-04; pink slip (delbros delivery receipt)

2008-08-06: Received text from Delbros that they will deliver my visa tomorrow or within 2 days

2008-08-08: Received my passport w/ visa and Visa packet. Hooray!

2008-09-04: Departure Date. port of entry: sunny Honolulu!

My I-129f was approved in 62 days from my filing date.

My I-130 was approved in 76 days from my filing date.

Not necessarily always required, but in your Husbands case they may request that letter with an RFE (so be prepared for it). Because he has been employed at this job for such a short time, I wouldn't be surprised if they did request a job letter.

2) Job Letters and Proof of Income Pay stub(s) showing income for the most recent 6 months and letters from all current employers are no longer required as initial evidence

The applicant, however, may submit either or both of these items (1) in response to a request for additional evidence (RFE), or (2) with a Form I-864 if the applicant believes doing so would help establish that the sponsor meets the governing income/assets threshold. If submitted, letters from current employers should show dates of employment, the nature of the job, wa ges or salary earned, number of hours/weeks worked, and prospects for future employment and advancement. It should be sufficient for the employer to say that the employment is of indefinite duration or words of similar effect. Promises of future employment are not required. link

Photocopies of the IRS transcripts shouldn't be a problem. I don't understand why you would be sending copies of tax refunds? Did you mean tax returns? If he is submitting IRS transcripts there is no need to send the returns as well. As for bank statements, are you two using your assets as part of the income qualification? If so, then I would include original copies of bank statements (should be able to get as many copies as you need from the bank).

You don't mention whether or not his Mother is using assets as part of the qualification for the affidavit of support. If not, if she is purely using employment income, then no, she does not need to provide the deed to her house.

If she is using the house as an asset then:

(A) Evidence of assets. Evidence of the sponsor’s assets should be attached to the Form I-864. Evidence of the principal sponsored immigrant’s and/or household member assets should be attached to Form I-864A. In each instance, the evidence should establish the location, ownership, and value of each listed asset, including any liens or liabilities for each listed asset. Evidence of assets includes, but is not limited to:

· Bank statements covering the last 12 months, or a statement from an officer of the bank or other financial institution in which the sponsor has deposits, including deposit/withdrawal history for the last 12 months, and current balance;

· Evidence of ownership and value of stocks, bonds, and certificates of deposit, and dates acquired;

· Evidence of ownership and value of other personal property and dates acquired; and

· Evidence of ownership and value of any real estate and dates acquired. (link as above)

thank you so much trailmix. that was very informative. so from what i've gathered from your response, the tax returns are no longer required if the IRs transcripts are submitted. i was just wondering about that because according to James' Shorcuts: "Federal Tax Returns: You need to collect copy of completed federal tax returns with all supporting schedules and W-2s for the 3 most recent tax years. Make sure to sign copy of tax returns. If you don't have a copy of W2's then you may request it via contacting your employer(s)." Is this no longer in effect? and just to verify, if my husband cannot provide a certificate of employment, will contract of employment should do?

The shortcut that is currently published in the Wiki is a bit misleading, they either want your transcript OR your tax return with slips.

As for the certificate of employment, what I was saying basically is that if you can only get the contract and you are going to go ahead and submit your I-864, then that is what I would send with it.

That said, anticipate that they may send you and RFE for a letter of employment.
