I am wondering about a hypothetical situation, so here I go.

According to the rules for married couple, no where it is being said that they need to meet up in person within the last 2 years or basically there is no mention of meeting in person.

Now the question is what if the couple never meets in person but does a proxy marriage? Marriage is legal by every means, so will it be approved at least at the USCIS and also at NVC level for either K-3 or CR-1 visa?

We all know the consulate level is unpredictable at best and it will all depend upon the consular if he/she feels the said relationship is valid or not.

This isn’t anything serious, just I am curious about how things work with VISA and apparently I have a lot of time to kill :P

Section 101(a)(35) of the Act provides that the term "spouse", "wife", or "husband" does not include a spouse, wife, or husband by reason of any marriage ceremony where the contracting parties thereto are not physically present in the presence of each other, unless the marriage has been consummated. (Note: Consummation of a marriage can only occur after the ceremony, there is no such thing as “pre-consummation” of a marriage.)

So basically you can have a proxy marriage, but you do need to "consummate" the said marriage before filling.

So does that mean that if a couple did have proxy marriage, they need to provide additional proof of evidence that their marriage has been consummated AFTER the said wedding date?

yes friend

i did proxy marrage( absence marriage) and after that my wifecame india (consummate)

we also talk embassy and federal thay said it valied as per us law. we did marriage and my we file PIO card for my wife so she can come india without visa. when she got pio card it mean GOV OF INDIA accepeted that she my wife and issue her PIO card. so we not ever regestered indian marriage cermony.

I was going through PIO and it seems to applicable to people who has at least some root back to India, so did your wife had any relatives from her father's or mother's side of the family who were Indians or did she get PIO solely on the basis that she is married to an Indian?

Wow....seems like a big change for someone to marry someone they have never met/have not seen in years, and then move to a completely different country on top of it all, leaving behind everyone they know.

As I said its a hypothetical question, but I am glad I asked this question, because I got to know about PIO for Indian citizens and their spouses.

when I went back to India to marry I had gotten a 10 yr visa so make travel easier for me...it is actually cheaper then the PIO card. I will consider the PIO card when my visa is to expire (if you noticed the PIO card expires in 15 yrs) at this time my husband should have his citizenship and be needing to apply for PIO too.

We have been looking for entry visa, that is 5 years multiple visa, allows the USC to work or live. But PIO options sounds good too, will have to talk to hubby and see what he decides.

Think when your husband will need his PIO, do go for OIC instead, with OIC, he can live more than 180 days without informing the authorities.
