Marrage and USA non-immigrant visas

Timeline

I cannot find a category that my fiancee and I fit into !!!

I want to marry a USA citizen and live with her in the USA for periods of up to 6 months at a time.

I do not want to live or work there permanently - we are both retired seniors.

I have several attachments to the UK - my pensions, property and family.

I am not interested in immigration or permanent residence.

My proposed spouse will live with me in the UK at other times.

Is there a visa I can use for this purpose, but still get married but be legal from all points of view??

If you have a UK passport, the visa waiver allows you to enter the USA legally for up to 6 months at a time. The B2 visa is a holiday visa and allows you to do the same thing. The CR2 allows you to come and go as you please, but if you remain outside of the USA for up to 12 months, you will loose it. Once you apply for the CR2, you can enter the use, but it will be difficult for you to do so and you will be questioned extensively by US immigration, because it is more likely than not that you might overstay because your wife is here. You would have to carry evidence of your ties to the UK. The visa waiver, or the B2 visa (if you can get a multiple entry indefinate one - not sure they still issue them indefinately) seems like the best option. You will be legal so long as you do not overstay.

I would simply live within the limitations of either the VWP or B2 visa. This will be simplified if you keep your current family name in your passport.

I am pretty sure it is 90 days at a time, but I still think it is the best option, though B2 tourist visa may be suitable too, if you really want to stay longer.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, VWP is 90 days but B2 allows up to 180 days per entry and generally disallows spending more time in the US than home country.
