Oh my gosh! I'm obsessing over every little detail! I just sent the choice of agent email to the NVC. I followed the format that I downloaded online but I didn't notice that the last name should come first, as indicated here:

http://www.visajourney.com/wiki/index.php/Email_DS-3032_form

So what I did was First Name Middle Name Last Name. I also didn't include the country, as it is fairly obvious San Diego is in California. Would these things matter?

I wouldn't worry too much. Ours was accepted about a week after it was sent. So you should know soon. Just keep calling the NVC to hear the status. But I do not think it will be a big problem.

Well, we are both new to this VJ site. We may have lot's of questions, since our situation is rather unique, so please bear with us! We are both living and working in Bangkok, although the spouse is from the Philippines. We came here so that we can have the chance to live together before this painful ordeal....We both decided we will file for the IR and K-3 at the end of august, as this will give us some time to get documents together and for us to get back to our home countries. So, here are some of our questions:

1) Does the US citizen need a police clearance from Bangkok? If so, would it be wise to get it from here, or to wait until we both get back to our countries? Or maybe a police clearance is not required from the US Citizen? Same question for the Filipina spouse? Will they want a police clearance after departing Thailand?

2) We worry about the AOS. The husband has not worked in the US since december and will have to immediately begin work upon arrival (won't be a problem). Will this delay things? Will the NVC make us get a co-sponser? These things are really bothering us and we hope someone can give us some answers in regards to the AOS and our situation. We obviously have not earned American income since at least december and we read that American $$$ must be the source of income on the AOS. We don't want to file DCF since we'd have to stay in Bangkok until at least december (our Immigrant visa's didn't "technically" begin until early june here in Bangkok). We just want to get the ball rolling ASAP. We hope someone can help us through the start of our journey. Thanks all! :innocent:

1) No police clearance needed for US citizen, only the spouse who is migrating needs that. Yes, your Filipina wife will need a police clearance from Thailand and any other countries she lived for more than six months after sixteen.

The police certificate usually expires in 6-12 months depends on the country, you need to factor that into the timeline.

2) Income requirement is easily overcome with a co-sponsor. But you need to establish domicile in the US in order to file the I-130 for your wife.

Were you on tourist visa before June because the work visa takes sometime to process?

Do check out whether the BKK consulate will consider you for DCF. It's the fastest route. Check out whether the BKK consulate the period on tourist visa as part of the residence requirement. Shot an email to BKK consulate will probably answer this question.

Another possibility is: you file the paperwork for your wife in Dec and leave for US after that, your wife can stay on to wait for the visa to get approved. You do not have to be present except for the initial filing.

Try to avoid dealing with USCIS service centers in US if you can. We regretted very minute for not doing that before my husband went home to America.

If you look at the timeline on this site, many people who filed in July-Oct 07 are still waiting for approval of their initial petitions. It takes very much longer and you will be separated with your wife for at least 9-12 months at current processing time.

It is always a good idea to type your surname in capital letters, and your first and middle name in small ones, to avoid any confusion, no matter what place the surname has.
