Hi! First off, sorry about my numerous inquires. I think i post a topic at a rate of about 4 or 5 in a month. Thank you for all those who have been gracious and patient enough to answer my incessant barrage of questions. =)

Okay, here's the thing. We're pursuing both k3 and IR1 since both petitions have been approved. We're going to submit the necessary documents to the NVC for the I-130 while pursuing the k3 here in the US Embassy. I was mulling over the scenario last night when I found myself asking what would happen to the I-130 in the US Embassy if I go to the US on a k3 visa and apply for adjustment of status. Do I have to go back to the Philippines to have my IR1 interview or just leave it be? Hmm....

I-130 Sent : 2008-04-08

I-130 NOA1 : 2008-04-14

touched: 2008-04-28

APPROVED: 2008-06-23

IR1 abandoned.

I-129F Sent : 2008-04-25

I-129F NOA1 : 2008-04-28

I-129F left NVC on the way to the US Embassy in Manila: 2008-07-02

2008-07-11: Called US embassy to set up appointment

2008-07-14: paid DELBROS doc verification fee at Metrobank and immigrant visa fee at BPI

2008-07-17: MEDICAL; referred to psych evaluation due to scars

2008-07-24: PSYCH Evaluation

2008-07-28: Result ready, asked to come back anytime for immunization

2008-07-29: IMMUNIZATION

INTERVIEW: 2008-08-04; pink slip (delbros delivery receipt)

2008-08-06: Received text from Delbros that they will deliver my visa tomorrow or within 2 days

2008-08-08: Received my passport w/ visa and Visa packet. Hooray!

2008-09-04: Departure Date. port of entry: sunny Honolulu!

My I-129f was approved in 62 days from my filing date.

My I-130 was approved in 76 days from my filing date.

That is a good question. I am also doing the same thing. We are currently waiting for our interview date for the K3. And yesterday I sent in the final paperwork, DS-230, for the CR1. I think that the I-130 should be complete before the interview for the K3 and we will be able to change the interview to a CR1 interview.

But if we ended up needing to wait a couple weeks longer for her CR1 interview, it would be worth it.

The K3 was first created to cut down on spouses time apart because CRs were taking a long time. [Life Act]. K3s would end up going to the US and then going back and doing the CR.

Times have changed and the CRs are much faster now.

As you guys know they are a MUCH better visa than the K3.

We found out the hard way. Cost us a LOT more stress and money doing the K3.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

This is the reason I am following both routes. Worse case, we will return to Buenos Aires for the CR1 interview. But I think I will be through the NVC before the K3 interview.

Yah, that's what I was thinking off. If I go to the US on a k3, am i eligible to apply for adjustment of status considering that my I-130 is already in the US Embassy or do I have to go back to the Philippines for my IR1 interview? Just in case, we're pursuing both routes. You're right, the NVC process is faster nowadays. A lot of people have been telling me that going through AOS once you get to the US on a k3 visa is a huge headache. I guess if we can put it off our rendezvous for a month in favor of a IR1 visa it would be well worth it.

It's good to know that the k3 interview is easily interchangeable with the iR1 visa. thank you so much Steve Y Jessica and Haole. =)

You can just leave it be. No worries, but you won't get back any money you send to NVC.

Facts are cheap...knowing how to use them is precious...

We went thru AOS and now wish we'd stuck with the CR-1/CR-2. Would have been cheaper and less hassle to fly back to Manila do the CR interview.

Probably would have got the GC faster doing so. If we'd been IR I'd DEFINITELY gone that route! Would have saved removing conditions also.
