Hi everybody,

I just had a 90 minute discussion with my fiance', and she is really nervous about having our K-1 turned down at the Kiev embassy. Apparently couples sometimes get a "no" without a reason behind it. In that case, what are the merits of trying to fix/appeal/refiling K-1 as opposed to just getting married and trying a different route?

Cart before the horse.....why don't you wait to see what happens before you brainstorm alternative solutions?

Agree, do best u can first, and most never know the reason. Then if that time comes you can file the K1 again or marry, but to marry does not give you any guarantee either so you just have to take one step at a time and do best you can

Jul 18, 2008 - Interviewed in Kiev. Everything went well!

Jul 24, 2008 - Visa received. Yippee!

Jul 31, 2008 - Visited my girl, and we spent my birthday in Odessa!

Aug 05, 2008 - We both arrive in America. Hooray!

Oct 31, 2008 - Married!

Appreciate it. I will relay the responses. What I was looking for was the relative timeline for those two things. Just trying to reassure her that there is a plan B and C, just in case. I'm not too worried at this point, and plan to go to the interview too. Any information would be welcome...even if it is belt-and-suspenders.

I don't think her anxiety came from VJ at all. A girl friend who had some one prepare documents seems to be the culprit. The posts actually say that many embassies don't give reasons. It seems like it would be tough to make a decision about what to do next if there is no reason given at all.

Ours was sent back only to expire and calif told me i was free to refile, others that are returned some to only lay with nothing for 18 months or more, we just chose to go ahead and marry now cr1. Yes it would be from the start again, with the addition of anything new you had to add

most people that get denied because the vo concludes you don't have a bona fide relationship. you could refile a k-1, but what better way to show a bona fide relationship than to get married and file k-3 or cr-1?

I'm not aware of Ukraine or other FSU K1 applicants having problems. You might want to check into the Russia forum and see what folks there say.

You are oversimplefying and panicking. Large numbers of applicants are initially refused a visa. In the vast majority of those cases, submitting additional documents within a matter of days or weeks, reverses the initial denial. It is rare (percentage wise) for a legitimate relationship to be faced with the drastic remedies you suggest and even more rare than average through Ukraine.

If there's a blue slip, respond swiftly and accurately. If white, do what you have to do to keep the case under consideration at the Consulate until you prevail.

It's not as simple as a single yes or no unless it's a yes.

Facts are cheap...knowing how to use them is precious...
