People here are trying to give you advice that will help you. Even if someone's words are a bit more harsh than they could be, they still have good intentions and want to show you your ideas are wrong.

You live in a country you compared to a prison, you chose to come here, you married a citizen of that country and your son will also be a citizen of that "prison". The way it seems now, you'll probably spend your life here, or one significant part of it anyway. You're saying American women "fool people", you're saying you want to divorce your wife and be free.. Yeah, you didn't explain how exactly you meant it, but if someone concludes what they did, can you really blame them? Don't be rude and say "you don't need advice at all" because that's simply a lie. You're here because you need advice. You have no idea what to do now and how complicated it is to marry a foreigner.. and you need all advice you can get.

Luckily, you came to the right place. :star: This forum is full of people who have learned a lot about how USCIS works and listening to them and following the guides you can save a lot of time, money and effort.

The way I see it, you should be totally ok. You married a US citizen and you have the right to adjust your status from an alien into a legal resident. What you have to do is prove that the last time you entered USA on a non-immigrant visa (like your student visa) you didn't intend to become an immigrant. With your wifes pregnancy you can prove easily you were... well... caught by surprise with the pregnancy (my guess anyway) and you got married because of her pregnancy (pregnancy not being the only reason obviously but let's just say it sped up things).

The best to start is reading reading the FAQ's and Guides. You need to adjust your status and ask for a Green Card. Before you get a Green Card, you can't travel in and out of country freely unless you have AP (Advanced Parole).

Whatever you do, good luck to you. And congratulations on the wedding and the pregnancy. :star:

I don't think anyone is attacking or lecturing you, babushka. People are trying to give you information based on what you have said, and based on experience and age. You have stated that you and your wife aren't very "mature" and you are actually asking for advice. If you can't take the reality that is presented to you, then you should not ask for advice.

Also, you are now married with a child on the way. They are your FAMILY now. They should come first.

Like I said ! don't lecture me, and stop BS me !!! cuz I can't sit here and listen to people that do not have nothing to do except bashing people.

No one is bashing you. People are asking you to look at the situation in the way you've presented it. Of course it's difficult to not see your family for long periods of time, but how on earth will divorcing your wife be a better situation?

Really? I mean...really? Seriously? People are giving you advice and offering a point of view, but you don't want to hear it because it's not what you like? There are solutions, suggestions, and opinions in this thread. Unfortunately you don't like any of them.

You say people here are self centered? You've attacked a poster who is offering advice and suggestions, and made a ridiculous comment about "I speak more languages than you" and then you say you want to be "free" and "see your family" when your wife and unborn child are here. You call us selfish?

If his visa expires in 2011, that is 3 years. Many things can change in 3 years, the wife could have a job by then, and be able to do the affidavit herself. Can't they wait a few years until their economic situation is better and then adjust? they have until the expiration of his visa to do so, right?

I'm no expert (far from it) but from what I understand he could do that if he stays in the US. If he leaves and wants to come back on a student visa, he'll have problems.

That is correct because unless any future US entry will be with intent to immigrate. Your freedom to enter and re-enter goes away once you marry a US Citizen. You are then deemed to have immigrant intent (because you do) and that's not allowed when entering with a student visa.

The OP already understands that. It's why he started the thread and feels like he's being jailed inside the borders of the US until he completes AOS and has a green card.

I don't really have any input for you other than good luck with the child on the way and I do hope (for the sake of the kid) that everything works out okay in the end. :star:
