I-765?

Hi guys,

Once you are married in the US under the VWP and you send out the I-130 and the I-485. How soon after or with do you send the I-765, and what are the chances of success? When will it be returned etc... If anyone has any previous stories on a situation like this it would be really helpful. I am looking to be employed as soon as possible to start saving along with my girlfriend for everything and wanted to know the details.

Any help is greatly appreciated!

P.S -- I've noticed a lot of the people who marry under the VWP spontaniously like myself have the low-key town hall or las vegas weddings. If you were to arrange some type of church wedding while you were here, would that be seen as too "pre-planned?" or would the interview not even ask about the wedding.

You include the I-765 with the I-485 in the same package with the I-130. The fee for AOS includes processing fees for the EAD and the AP (I-131) whether you use them or not. If you send the I-765 in separately afterwards, then you have to pay an additional fee.

Regarding the church wedding, it may throw up some red flags if it looks like a wedding that takes more than a few months to plan (ie. booking a church, etc. a year in advance). Keep all of the paperwork that shows when you made the arrangements to prove it wasn't before the VWP entered the country - (and also not within a few days of entering the country as that also indicates they may have entered with the intent of getting married). Make sure the arrangements are made 'after' the engagement happens, and if the question comes up you are prepared to answer it. Many spur of the moment weddings are more' moment' than others so a quick trip to Las Vegas or a court ceremony works for them. Just because you decided while here on a VWP to get married doesn't mean you need to forego a church service with friends and family if that is what you want. From reading the accounts of interviews posted from others who married while on the VWP, the question often doesn't come up. Just be prepared to answer it if it does and you should be fine.

You can send the 765 together with the 485. Or you can send it afterwards for no additional fee, as long as you include a copy of the NOA for 485 showing that you applied.

Why not to do a low key courthouse wedding now and then a church wedding in a couple of months, so you have time to plan it and it doesn't look suspicious?
