I am heading over from Australia to Houston in September to spend 3 weeks vacation time with my new hubby. My grandmother is travelling with me for the experience (she has never been overseas before).

Does anyone know when POE becomes an issue in terms of your IR1/CR1 petition? At this stage we have only received NOA1 and since we are going through slow Vermont, I doubt we will even have a NOA2 by September (but it is possible).

I will be travelling with the following proof of ties to Australia:

1. Return tickets + itinerary

2. Travel insurance to match itinerary

3.Letter from employer

4. Letter from University (have to hand in dissertation at the end of the year).

5. Custory documents for my 2 children

6. Rental lease

7. Duplicate copy of the petitons for myself and 2 children + NOA1 for us all to show that we are trying to work with the damn system. (we wouldnt petition for 3 people, only for me to leave my kids behind in australia but I guess stranger things have happened).

8. My grandmother's itineray and travel insurance will also match mine.

At what stage will they know we have submitted petitions? Do you think my proof of return is adequate?

CR-1/IR-1 Journey for Self

12th April 08 - Married in Australia

21st April 08 - Mailed off I-130 but with incorrect title on cheques

30th April 08 - USCIS returned petitions requesting correct title on cheques

2nd May 08 - Mailed out I-130s again! Finally on our way!!!

9th May 08 - NOA-1

7th Nov 08 - Tranferred to CSC

4th Dec 08 - Approved!!!

22nd Dec 08 - NVC # assigned

23rd June 09 - Case Complete at NVC (We slowed down the process on purpose to time interview accordingly)

18th August 09 - Medical

25th August 09 - Interview Date - Approved!!!

19th February 10 - POE L.A (No dramas, just SLOW)

2nd March 10 - Welcome to America Letter

You'll be fine.

Just say you are "visiting" and do not mention anything anymore. No need to say who, if not ask, just say you are visiting NASA!

If they ask you a precise question, reply the precise question, with as little detail as necessary. They will let you in an never ask for a thing. If I were you, I'd approach the desk with your granny, especially if she is an elderly lady (like if you were helping her out...).

I wish you luck with the NOA2, perhaps you might be lucky with the NOA2, but still they could refuse you entry theoretically, so do not worry about NOA1 or NOA2 and just be natural, smile, joke if you are a joke type and relax, they let you through all right.

Thanks for your response charisma1. I really doubt I'll get a NOA2 by the time I leave but I would like to know when border patrol become aware of the submission of the petition. Any one else got a take on this?

It's not really clear what they know about the application of petitions at the POE - some people think it comes up on their computer and others don't. I've visited twice since getting the NOA1 and the subject of a visa never came up. The first time I said I was there on vacation to visit 'family' and there were no further questions. The second time I was asked who I was staying with and I said 'my husband' and there were no further questions. But like you I had lots of information at the ready to show I was going home - return ticket, letter from employer, letter from landlady etc. I didn't need to show any of it though.
