K-3 is a VISA (e.g. it would be the permission for your husband to enter the country legally). You already filed and used the K-1 VISA for your hubby to enter legally as a fiance. Now after marriage, he must adjust status to become a permanent resident (and get a "green card"). That is the "AOS" we're talking about here. Yes, it's $1010 filing fee, I'm afraid. And I wouldn't bother trying for a fee waiver... Been there, tried that. Do a cash advance on your credit card if you have to; at least you finally found a joint sponsor.

From what I recall, I think only 1 year of tax returns is required, the employment letter (stating income, hiring date, and continued employment), and the affidavit I-864 (each of these for both you and your sponsor). I would add additional tax returns if there's some inconsistencies (dips) in income and your prior returns can show more.

Good luck, Meri.

I sent three years worth, as a friend of mine from Auckland sent only the one years, as requested, and got an rfe for the other years. Even though they don't ask for it initially. I decided on a take no prisoners approach and sent the lot right away.

I can explain it to you. But I can't understand it for you.

Cham..here is a link to the AOS guide here on Visa Journey. After he has arrived here and you get married he applies for AOS, adjustment of status, and he gets the 2 year green card. Once you have that, and before it expires you apply to lift conditions and receive the 10 year green card.

Have a look at the link, it's all there.
