i have a question..i dont know if it makes sense though..

my fiance is moving to a new place. so we are going to call USCIS to update his address...can i ask the person from uscis to also approve our application since they've already approved lots of july filers? are these the same person who reviews the applications? or will it help fast approval coz they will be pulling out our application at least i know that it isnt lost... hope u get what i mean...what do u guys think? thanks

Is your fiance the USC? Only the USC can have address details changed by USCIS over the phone, the beneficiary has to have change of address details put in writing by petitioner and posted in.

I wish it was as easy as just to ask them to approve you at the same time they have your file out...if this was the case everyone would be doing it. I don't think it will speed up the process for you either.

But it's worth a try.

i am the benificiary and He is the USC. i told him about the idea a while ago before posting and he told me to call the lawyer that handles our case and ask her what she thinks.. maybe u guys are right.. i sound desperate i know..lol..but it is for real that he will be moving this coming sunday. anyway, he or the lawyer will still make a call tomorrow. we'll still try our luck and ask for it since theyve been processing july, it will only speed up a lil bit of the waiting just in case.i dont see any harm in trying...i hope there's not.

as you some of you know my co-sponser back out on me and now we are scrambling to find a way to get him home.

I make 16,292 min and up to 17540 max (with overtime which I get alot of )

I also only have one tax return from last year which shows ####### on it because I was released by the doctor to go back to work finally. It only was 5k on it as it was the end of the year. Before that I never worked and my ex was the one who filed.

Can I use my SSI of 546 a month as well to add to it. I dont know what I can use for assets..my car is not in my name yet ( almost as I making payments...) I dont have much in savings and I fear this will break us if I cant get him home..we are both bawling and pissed off right now.

My son was a complete jerk about the whole thing and I tried to explain to him about it...yet he made me feel as if I was a burden to him.

I feel horrid inside and feel like dying I do not know what to do.

I JUST WANT HIM HOME and I have no one to cosponser at all...no one

I've been thinking about ways to get around this. I have some but I'm not all too sure how ethical it is. It looks like you're only about $3600 away from meeting the poverty guidelines. Can you temporarily borrow that from a friend or family member? If you put that money into a savings account then you can count it as assets for the affidavit of support. Additionally, if you file your 2008 taxes right away - beginning of Jan - you could submit that with your affidavit of support and your income would be higher than previous years. Is your employer at all flexible with your hours? I don't know how much OT you can pull in the next month but if you can do alot that may pull you over the poverty guidelines in your 2008 tax return. I hope that is helpful. I'm really sorry that you're having a difficult time.

Thing is I been at this job going on 7 months now and the raise is FINALLY showing up.

Someone from Oz said I dont need the tax return that they just asked for bank statement (which I will file and claim my neice and nephew as they been here 6 months and their mom (my sister) wont make enough to get squat SO we are going to file that into the bank (which should be around 4 to 5 k) and THEN mail that over night (3 to 6 days to kai for his interview)

BUT from what the post said that aubry posted it looks like I can use my disability pay i get as well and I am working on getting a second job

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

Don't forget that if you're using assets to qualify, divide what they're worth by 5. They also must be generally liquid - like cash savings, stocks, bonds, etc. I'm not sure jewelry would qualify at all, but seeing the value it wouldn't help you meet the number much anyways.

Sorry for the sour news on that.

If you think you're close, you can always submit what you have and hope it flies at the interview. The worst that can happen is they tell you you don't have enough for now, and they give you a timeline of when to meet it.

I know you'll get this to work one way or another, Cham. We're all here for you!

Well I thought of that they want 100% and if we tell them and can show them the bank statement of the balance FROM the savings well that would be cool! I could handle that...

I hear ya, getting restless myself. well we normally see most approvals thurs and frid. I hope it picks up soon. My timeline keeps going back...it was late november now it says january. everytime i get to the adjudication time, they move it just out of my grasp! its like they are playing mind games! :wacko:

us to...its coming to the point that if he is denied he is STILL coming no matter if I have to drive to another damn state to get him. We refuse to go through this BS again to only be denied due to a lack of a lil funds...COME ON

I have read that most go for the 100% not the 125% SO im hoping Australia is that as well

The thing that upsets me is that my son in law makes alot of money and at first he thought about doing it but then when keith went back home unexpectedly last may , my daughter doesnt think he will. :( I am so tired of things coming up and getting in the way .. Now I have a question. about this one needed for this stage. on the paperwork does it state that it is not legally binding?? because if it does he just might think about it .. let me know

Now I have a question. about this one needed for this stage. on the paperwork does it state that it is not legally binding?? because if it does he just might think about it .. let me know

Unfortunately not :(. #6 on the I-134 says, "I understand this affidavit will be binding upon me for a period of three (3) years after entry of the person(s) named in item (3) and that the information and documentation provided by me may be made available to the Secretary of Health and Human Services and the Secretary of Agriculture, who may make it available to a public assistance agency." Also, I'm pretty sure the I-864 is legally binding, which you'd need after marriage. Someone correct me if I'm wrong!

I wish you guys all the best in figuring this stuff out and hope for a lot more approvals today! As for me, I'm off to take a very dreaded nursing exam. Yikes!

The I-134 unfortunately doesn't state that its not legally binding.

Perhaps if you show your son-in-law the paperwork required for AOS including the I-864 affidavit of support and explain that it is that one that is legally binding and not the I-134 you are asking him to complete.

Hope you get it figured out, last thing you need is all the extra stress.

I am crying as I sit here because we have been through so much. So many bumps in the road along this journey that we have been on for 2 years. Having to say goodbye yet again on monday and now this. I am trying to be strong , I really am. We are so close now , I just pray that everything turns out in the end because if he is denied I will set him free as neither of us can do this anymore. Its to damn hard and I dont understand what rights anyone has to keep two people apart that love each other and cause so much stress on us all. They should see that we are real , they should see how much we love our fiances because if we didnt we surely wouldnt put up with all the ####### that we have to go through just to be together. Money sucks and the thought that this is what could come between us and stop us from being together makes me mad. Im sorry guys I know negativity isnt allowed or wanted in here , I am just overly tired from my trip, and scared to death
