Hi - I was just about to file the I-129f for my girlfrind Phuong when she told me she thinks she can get a work visa and be here within a month or two. She says some company in America who hires Vietnamese that are specially trained in hair and nails (she is) can bring them from VN to USA within 1-2 months time. Anyone heard of this? Is it true? Obviously, I would rather have her here sooner than later but it worries me if she goes for it, gets denied, then they really won't give her a fiancee visa (I would think). Anyone know about work visas and whether or not this is just a load they are shoveling her? :huh:

Hey Jonas,

Though I have never heard of this program I have heard or others very similar. My fiance wanted to try to go through the visa process on his own (not through any special program though) but I was to scared that if he was denied then It would be more difficult for us to do the whole K-1 thing. I personally asked him not to. And though I understand your position and how nice it would be to be with her NOW I think it would probably for you to just do the k-1 visa because you don't wouldn't want to go through the risk!

Hey this could TOTALLY be out there, but I do know that these kinds of things you really have to be careful of.

Not to say this is on the same level as human trafficking, but there are mafia run organizations such as the Triads that guarantee work visas for foreign people who, when they get to the US, have to work off a "debt" that they have accumulated for getting them to the US, etc., and basically are owned by the people who brought them here.

It's scary/ridiculous/cruel but that does happen.

I don't want to scare you as this could totally be legit, but just be careful obviously, talk to people who have actually done it through this company, and make sure it's 100% legit, safe, and there are no strings attached.

I'd just go with the fiancee visa, personally. But I am of the ilk that if it sound too good to be true, it probably is.

Quicker isn't always better and in this case...your gut instinct is probaby right...you even wrote "Scary" in the title...

you think it's risky, because it is.

I wouldn't do it.

I would be very, very, careful with this. There are a number of red flags - work visas are not easy to come by and certainly take more than 1 -2 months, (although if someone has received permission for H2B workers it is possible). There are a limited number available each year and the cap has been met for this year already. Some very well qualified professionals wait for a long time to get an available work visa. Most work visas are to fill jobs for which there are no Americans available to fill, and while there are lots of nails and hair salons, there certainly doesn't seem to be a scarcity of available Americans to work there either. The sponsoring employer must submit evidence to show that they can't find anyone in the US to do the job due to special skills required or the unique qualification of the applicants. The concern that I have is that there are 'recruiters' who promise work visas to young women from foreign countries but when they arrive they don't get a work visa and are put to work in less than savory circumstances - with the constant threat that they are illegal and will be arrested if they are caught. If the work visa is legitimate and is in the H-2B category, the applicant must convince Immigration that will only remain in the US temporarily and will leave when the work visa ends. Then, there is also the concern stated above about a 'sponsored' employee being given a huge debt upon arrival and not being able to work it off.
