I'm hoping someone can clarify this:

The I-129F and I-130 were approved at the CSC on May 8th. The I-130 has never been sent to the NVC, even though on the notice it says it will be.

The kids are wondering if they have a choice of visas - the immigrant or the K-3. Has anyone else been in this situation lately? Did the CSC hold the I-130 and send it to the NRC expecting them to adjust status or send it to the NVC? The K-3 visa interview is already scheduled for the 24th. The beneficiary's career situation is keeping her in Thailand longer than expected, so they were hoping the immigrant visa might still be a possibility. When she does her corporate transfer it would be nice to able to go to work immediately here. My son is leaving for Thailand for six weeks and getting here faster is no longer the priority.

I called the USCIS twice about it today. The first "customer service" rep, Jennifer, insisted it was necessary to make an info pass appt. (never mind that it is 250 miles to the nearest office and the petitioner is leaving the country on Tuesday). It would be tragic to drive 500 miles and get another dumb answer. The second rep. was much nicer and looked further into it, but ended up telling me to call the NVC. I talked to the NVC and they said there is no record of the I-130 being received. You can see why they're having second thoughts about adjusting status here! No USCIS=a better life.

There seems to be no way to tell if the I-130 is being held back, or where it is, for that matter.

Thanks, John. They were very clear in their applications about going the K-3 route, so I suspect the I-130 was held back.

It's a bit disconcerting when no one seems to have a clue as to it's where-abouts or what the usual procedure is in such cases. My DIL has an interview appointment, so we can't complain. If it weren't for his career situation they would just live in Thailand.

The I-130 will be used when she adjusts status in the US. I had to send a copy of Rin's I-130 NOA2 with her I-485. We had never filed I-130's for the children, so had to file them concurrently with the I-485.

Update: July 17th: I thought I'd try phoning the USCIS again regarding getting the I-130 sent to the NVC. An officer put in a request to have it sent! Perhaps the kids will have a choice after all, since my DIL is currently looking at coming here in February. I am not holding my breath, but it is very encouraging to talk to people who are nice and truly try to help. USCIS gained some points from me today. We'll see what the outcome is.
