post-22266-1147635550_thumb.jpg :help:!!!!

I am so confused by all the information I am reading! My name's Tiffany and I am from Ontario. I am dating a wonderful man from Chicago and we want to get married and have me move there. The major issue is we don't know where to even start. I have been researching on the internet but there are so many different websites with contridictory information that I am incredibly confused.

We are wondering what the best and fastest way is for us to be together. Anything at this point is an option. We have talked about getting married before I move if it will help the process or getting married after if that is quicker. We just want to be together and not 8 hours away. If anyone has any information on what will be the quickest and easiest way for us to go about this, please let me know.

THANK YOU!!!

Tiffany

There is a lovely guide that points out the pros/cons/differences of whatever route you decide to take... it's somewhere up in the guides and faqs... not one visa will be a one-size fits all, so you can juggle around with your needs and the time frames.. :) OH BTW welcome to VJ

My wife is from Nova Scotia. We chose the K-1 route. At the time it was the fastest. However, with the addition of this new IMBRA law, I am not sure which would be quicker any more. I can tell you that by following the guidlines found here on VJ, we have proceeded through the process without any flaws so far. The people on here have always been pretty helpful.

As far as living here while going through the process, Danette entered after we had filed for K-1 using her drivers liscense and birth certificate as opposed to passport. She did NOT bring all of her belongings at that time. There is a chance that you could be denied entry if the officer at the POE feels you are trying to move here illegally. So it is NOT guarenteed that you could do this.

Technically, you can visit the States, not live here. "Live" implies that the States would be where you are resident.

As a Canadian, I believe that you get a bit more latitude from the perspective of how long you can visit for. Maybe that would be an option for you. You cannot work here, however, until you have authorization to do so from the USCIS, and you cannot file for that authorization until after you are married. It then takes about 3 months to get the authorization after applying.

So, if you did manage to stay in the States through the process, you would be out of work for 9 to 12 months (6 to 9 months to get the visa, get married, and file for your green card, then another 3 months to get employment authorization).

also, you can be in the US when you apply, so you could knock of some of the early waiting time by going over and applying and then using up the rest of whatever time your allowed (90 days on the visa waiver prog). you would have to come back if your interview was scheduled before the end of your time though, but that would be very lucky :D

In addition to what other people have already said before, I suggest you also look into which service center your application will be going to. Some service centers are faster than others. When you know which service center you're going to be mailing the petition to, see the processing times above. You can check and see where they are in terms of processing the I-129F (K1 or fiancee visas) and/or I-130 (CR-1 for married couples).

Since you live in Ontario, you most probably will be going to Montreal for the interview. The wait now for an interview is about 4 months from case completion (for CR-1) or from mailing in Packet 3 (for K visas). However, things may change (they may speed up or slow down at any given service center or consulate).

Basically, it's really hard to tell which would be a faster route.

We're doing the CR-1 (and K-3) route. Our CR-1 is taking a long time since we went through the California Service Center.

Good luck and welcome to VJ. :)

With all the recent changes to immigration law, it is difficult to know which method would be fastest. It may all turn out to be the same. Going the route of getting married and filing for CR-1 and K-3 has turned into an 8 month process for us. Interview is in 4 hours so this should be getting close to the end of our separation. I am not familiar with the rules for Canada in reguards to filing at the consulate. If that is an option, it is almost certain to be the fastest way.

Giggles, If you plan on trying to come across and stay throughout most of the wait, I would suggest renting a storage building for your belongings. That is what Danette and I did and it worked fine. Just be careful not to try and carry too much stuff with you. The officer at the POE might figure that you are planning on staying from that point on, instead of waiting for your visa. If they believe that, they WILL deny you entry. Your name will be red flagged and you might not be allowed to visit until your visa comes through. So caution is required.

Not trying to scare you, I am just pointing out the facts.

Feel free to PM me if I can be of any help to you.

Bruce
