I am so frustrated with this process:

Filed my AOS May 28th.

My husband is in law school, and we live with his parents. So he filled out the I-864 (does not meet 125% poverty line and no assets) and his father fills out the I-864A. His salary well exceeds the required income so we did not give asset information as the form says to do so only if required. We sent supporting evidence of my father-in-laws salary- letter from employer & 2007 tax return

This morning I received a RFE stating "based on the documents submitted with Form I-864, the petitioner/ sponsor and household did not meet the 125% of federal poverty line. In order to process your application further, obtain a joint sponsor or submit evidence of assets (goes on with evidece of assets).

Here's the confusing part, it then says at the bottom "For specific information, see form I-864A instruction page 3 "Assets""

SO - what do I do? I called USCIS twice and both times was advised to just submit the same info as before - they said maybe the immigration missed the I-864A we sent or that it was lost!!! Unlikely.

They said not to have my father-in-law fill out the I-864 as we live with him. But what do I send? As my father-in-law's salary is more than enough for the salary requirements it says not to send asset info. Should I just in case anyway even though the instruction page says its not necessary. Is it the I-864 they want assets for or the I-864A?

I would just send exactly what you sent originally. This wouldn't be the first time USCIS have screwed up. :wacko:

Actually, that is highly likely.

I think so too but i'm nervous that they will send another RFE. What happens if you get more then one RFE for the same thing?

I just can't figure out what they want and no one at USCIS will tell me!
