Hello,

I am a new member here, but I have been reading this Forum to help me with this Visa Journey for my Wife:) We have just been approved for our I29f and I30 on June 29, 2008 at VSC. I am an American Citizen. My Wife who is currently in the Philippines is 37 weeks Pregnant. Our son will be born in the next couple of weeks:) My question is what is the process for my son to get here as soon as possible? With no further delays...

I know that we can report "Report of Birth of a Child" (http://manila.usembassy.gov/wwwha003.html#Report) ;Form DS-2029 in the US embassy in the Philippines but how long will that take to process? Will my son be a natural born US Citzen? If not, What kind of Visa will they give to my son to enter the USA?

I also know that our soon to be born son can be added as a Derivative to the K3 Visa. Derivative- Link (http://manila.usembassy.gov/wwwh3236.html),

We are interested in going with the K3 Visa route because we are trying not to have any more delays. If my son gets added as a derivative to the K3, I am assuming my son will get a K4 visa than.

Do we have a choice on whether Reporting Birth of a Child procedures or just adding my son as a derivative? I am just trying to get my Wife and soon to be born son here as soon as possible. The estimate time for getting her interview is about 3 months. I am just hoping with our soon to be born son that his papers will not delay us much longer.

We also just realized she will need to get a POLICE CERTIFICATE from the Japan embassy because of her being in Japan for more than 6 months while getting her Masters Degree in Japan. The process can take 2 to 3 Months:( This report is needed for her Interview.

Any advice is really appreciated...Thanks for your time

If a child has any potential claim to US citizenship, then that must be determined first before any other "path" will be taken. Besides USC is really the best way anyway so you should want to get that settled.

Your son will be a USC, no visa needed. Report the birth abroad at the embassy. They will issue him a Certification of Report of Birth of a United States Citizen, DS-1350. This will be he considered his birth certificate, just like a state or county would issue, but it's from the Department of State. He is not considered "a natural born citizen", but one who got his his citizenship from a parent. I don't know if they still do this, but my son's passport was issued the same day in Frankfurt.

Ask the embassy about this. My husband was on active duty at the time. Just make sure you take the baby to the embassy with you! As for the report of a birth abroad, save the original you get with your valuable papers, as the DOS will not replace them anymore. It has information on it that may be helpful on down the line. We included copies with my son's petitions for his wife, as they have more information on them than the Certification of Birth. It actually proves that he was an Army brat, in case there was any doubt.

As a USC, he does not need, nor is he eligible for a visa.
