By the way, I know there is this rule that my wife has to leave the US within 45 days of her oath. Will the officer ask for proof of this at the interview? Right now, we have a flight for 5 April. This means that if the interview takes place before 25 February, our flight plans will show 50-55 days before we are planning on leaving the states again?

This is very premature, since we haven't received our interview letter yet...but does anyone have any thoughts? Did the officers ask you guys for proof that you would be joining your USC spouse abroad within 45 days?

That's one of the big questions I hope to get answered at our interview whenever it is...

Ha. I think we'll take a copy of our e-ticket, and explain that it is a flexi-ticket, in case they start counting the days. Who knows, maybe it won't be an issue.

The wait always forces me into worrying wayyyy ahead of time.

Hey guys,

So I just found out that Milena's 319b interview will be in Atlanta on 12 February 2009. We will bring everything we have used on our immigration journey, including proof of bona fide relationship. I will have information documenting that we will be posted overseas for at least 1 year after she is naturalized (until September 2010), and she will be ready for the civics test.

My only question is this: the 319b process requires that the newly-naturalized citizen leave the country within 45 days no? Right now, our flight is 51 days after the 12th of February. Should we change this? Will they ask for documentation to show that we are leaving the country within 45 days? Is there a chance we could have the oath a week or two after the interview? (Atlanta usually does oaths on the same day?) We are having a child around the 8 March, so it would be nice not to be rushed out of the country. :)

Thank you guys so much for your help on this. I am certain I could have never done it without you guys. Or at least without paying the $1000 lawyer fee that I was quoted for a 319b application!

How can I do that if I don't know when the oath ceremony is or how long it will take to get a passport? Have you tried calling USCIS? Last time I tried that, they didn't even know what I was talking about. Maybe if I can get to a higher tier customer service person. My wife's interview is on January 26th and I'll post an update with what I know the same day.

I think I will go in with the plane ticket we currently have. If they ask, I can just request an oath ceremony on the following week. Worst case scenario I could move the flight up a few days and pay any necessary fees.

By the way, I think passports can be done fairly quickly these days...5-10 days, especially if you are willing to pay for expedited service. There are a number of good threads on this.

Where did you get this info? :blink:

You and your wife can leave anytime you want to, provided that the ceremony took place and she received the certificate. You both can stay also in the US (better), as remember your wife is a US citizen, meaning she can stay whenever she wants to in the US and she can also deliver the baby there. To tell you the truth, staying in the US FOR A COUPLE MORE WEEKS will benefit your wife to apply for the passport in the nearest passport agency. and also you have to give consideration that she is in her 8 months pregnancy the airline may not allowed her in the airplane..

Even if she can apply passport in the nearest embassy overseas, please try not to do this, make sure when you both go back to bolivia, make sure she have the passport already.

The only thing you have to worry for now, is the oath ceremony if that will be the same day, but you can ask the officer if they can do it since your wife is pregnant..

The reason why I joined this forum is to help people do the application for 319b without hiring a lawyer, everybody can do this without wasting money...

I didn't read the whole thread. Just a quick note: If you are stationed overseas with the Armed Forces, you can file under Section 319( e ) and can do the whole citizenship process overseas:

(3) Filing for Naturalization from Abroad Prior to and After the Enactment of Section 319(e)

Prior to the enactment of section 319( e ), with some exceptions, a service member’s LPR spouse residing abroad with the service member had to apply for naturalization under section 319( B ). This applied to a spouse who was otherwise eligible for naturalization under section 316(a) or 319(a) but whose time abroad rendered them unable to meet the respective continuous residence or physical presence requirements. Though such an LPR filing under section 319( B ) was exempt from the continuous residence and physical presence requirements,14 he or she was still required to return to the United States for his or her interview, naturalization, and any other related procedure.15

The enactment of section 319( e ) allows such an LPR spouse to apply for naturalization from abroad pursuant to section 316(a) or 319(a) and complete any procedure relating to his or her application for naturalization while residing overseas.

Hello everyone,

I am writing because one of our fellow 319b applicants was declined at the last minute (after a 7 month wait), because the officer that interviewed his wife said they had not been married for 3 years. His immigration lawyer is now making his case to the officer, and hopefully there will be a happy ending.

I read the Immigration and Naturalization act many times before filing and talked with a few lawyers. Being married for three years has nothing to do with citizenship! Being a resident of the US for 3 years is a requirement and being physically present for 18 months is a requirement, but both of these are waived if you apply under 319b.

I am especially concerned because my wife and I are going to her interview in Atlanta in three weeks, and do not want the same thing to happen to us!!!!! Yikes!!!

Thoughts, anyone?

His immigration lawyer is now making his case to the officer, and hopefully there will be a happy ending.

The officer might be new and do not know what she/he is doing.... When you applied for 319b, it waives all the physical presence in the US provided that you have strong reason why you live overseas..

My co worker did get approve first before me, and they are not even married for 2 years.

I went to my local USCIS office today to ask some questions about expedited naturalization. The person answering questions had no idea what I was talking about and claimed its not possible even though I was holding a USCIS document in my hand explaining it. I've called the USCIS customer service number a few times and get the same response. At least today she agreed to have a "USCIS lawyer" call me. I asked if I'd get a phone call today and the response was, "ha, yeah right." I'm attempting to do this without hiring a lawyer, but it is looking like I'll have to get one anyway.

Hi I just did my Naturalization under 319b last March and did get an interview on june 08 and have the oath at the same day.. There is a lot of people that are not aware about 319 b. If you are a contractor working overseas, and your wife is coming with you A letter of Authorization or LOA, LOI will support her application for her. I did try asking a lot of question to different people before I filed the n400 in March 08.. I figure since nobody can give me information I will just go ahead and submit all the requirements they were asking.. I dont care if I will lose hundred dollars what matters is I tried it, since my GC will expired in Nov 08, I just told myself I will give it a try and I've made it.

Here is what I enclosed in the packet (in order)

1. Cover letter (stating you are working overseas and you are applying under 319b, your job, your company) I can send you sample if you want.

2. Filled N400

3. PICTURE

4. Tax info (for for years, joint or not)

5. a letter from the company (notarized)

6. employment letter (job offer-notarized)

7. Employment agreement (notarized)

8. (2 )fingerprint card (done in US Embassy overseas)

I am a Greencard Holder and my husband is a US Citizen. We are now living in China (overseas) as my husband was assigned here and working in American own firm. And now we are sorting it out on my Expedited Naturalization process. I have couple of question in my mind and I hope you or other members will be able to help me.

1. Where can I get/request those fingerprint cards? For COMPLETELY - did you do this in Philippines?

2. Where did you notarized above item 5-7? My husband's company already have given us Company Letter from US but was not notarized. Can we just notarized this here in China or any place? Does it matter?

3. With regards to item 10 - Department of Defense Certificate of Overseas Assignment - where did you get this? I assumed at US Embassy where your husband is stationed?

4. Who will issue this LOI? We are now living overseas and will just start process from here. so maybe this one does not apply for me as we are now living overseas?

Your advised is much appreciated! FYI: Based on your list above, I have gathered almost all of them except for item 8 - fingerprint card, item 10 CAC, and item 11 LOI.

Hi there! Congratulations on your approval! Your posts based on your experience is very helpful as it is direct and organized. I am planning on applying for Expedite Naturalization. I am a Greencard Holder and my husband is a US Citizen. We are now living in China (overseas) as my husband was assigned here and working in American own firm. And now we are sorting it out on my Expedited Naturalization process. I have couple of question in my mind and I hope you or other members will be able to help me.

1. Where can I get/request those fingerprint cards? For COMPLETELY - did you do this in Philippines?

2. Where did you notarized above item 5-7? My husband's company already have given us Company Letter from US but was not notarized. Can we just notarized this here in China or any place? Does it matter?

3. With regards to item 10 - Department of Defense Certificate of Overseas Assignment - where did you get this? I assumed at US Embassy where your husband is stationed?

4. Who will issue this LOI? We are now living overseas and will just start process from here. so maybe this one does not apply for me as we are now living overseas?

Below is the answer to your question:

1. Where can I get/request those fingerprint cards? For COMPLETELY - did you do this in Philippines?

answer: Call the nearest US embassy in your area where you reside and ask them if they do FINGERPRINTS.. I would prefer to just go to the US embassy personally to get this done.. The FP cards is FD-258.. Tell them that you will be using this for N400 Application.. Once they did FP for you, they will put this in the envelope and seal it and put a stamp on it and mark is for N400. You will pay a certain amount of fee.. I am not sure how much, but I did pay 100$ i think.. I did this at the Embassy in the Middle East.

2. Where did you notarized above item 5-7? My husband's company already have given us Company Letter from US but was not notarized. Can we just notarized this here in China or any place? Does it matter?

Since I work inside the base in the Middle East, I brought all my documents to the military legal office and they did it for me. For you, you can bring this to the Embassy when you do FP, and have your husband go to American Citizen services, I believe they do notarization there.

3. With regards to item 10 - Department of Defense Certificate of Overseas Assignment - where did you get this? I assumed at US Embassy where your husband is stationed?

The company issued this to my husband when he gets stationed in the Middle East.. We both work as civilian, so we both have this.

What type of company does your husband works for? Is he a contractor for the US Government? If he is working in a commercial firm that deals with the US Trade..

This is what your husband need to include in your application:

A letter on official letterhead which states:

o The title of the official attesting to the facts in the letter;

o The name of the institution, firm or corporation and whether the official has access to the company’s records;

o The nature of the business that the employer conducts;

o The name of the State under the laws of which the employer was organized and the date of incorporation, etc.;

o The ownership structure of the enterprise; and

o The facts of your spouse’s employment, the basis of your spouse’s hire (contract, permanent employee, etc.), and the length of your spouse’s overseas employment.

4. Who will issue this LOI? We are now living overseas and will just start process from here. so maybe this one does not apply for me as we are now living overseas?

if he work in american owned firm, disregard LOI, this is only for US Government contractors .

Hi all you 319b filers. I know most of you got oaths the same day, but what about you guys who did not?

There was no oath today after our interview, so we were told to come back next Friday. On the way out, we asked, "What time," and they said we would get a letter in the mail in the next two or three days or that we would get a phone call.

Strangely, they called about 30 minutes after we left, but we were not yet home. We got home an hour later.

Should we call back? They left no message. We just want this to be over, but we feel like it is. We have the little letter that has "Congratulations" checked, but no official oath letter.

try to call back.. like what i have said before, agencies may varies.. some do the oath at the same day...but no worries... You are almost done with the process.

COngratulation.. My friend also is a usc now, she did it in VA.
