Hi all you 319b filers. I know most of you got oaths the same day, but what about you guys who did not?

There was no oath today after our interview, so we were told to come back next Friday. On the way out, we asked, "What time," and they said we would get a letter in the mail in the next two or three days or that we would get a phone call.

Strangely, they called about 30 minutes after we left, but we were not yet home. We got home an hour later.

Should we call back? They left no message. We just want this to be over, but we feel like it is. We have the little letter that has "Congratulations" checked, but no official oath letter.

Thoughts?

try to call back.. like what i have said before, agencies may varies.. some do the oath at the same day...but no worries... You are almost done with the process.

COngratulation.. My friend also is a usc now, she did it in VA.

Thanks Completely. We are very happy, but won't totally relax until we have the naturalization certificate in hand. As I mentioned, the IO said the oath would take place this Friday at 1pm and that we would receive a letter. After reading other posts on the subject, I decided not to call back at this point. If we don't have an oath letter by tomorrow or Thursday we will call before heading down to Atlanta again on Friday. Hopefully we are almost done with US immigration forever!

So we are still waiting for the oath letter, and I am getting a little bit worried. As i mentioned in other posts, the IO said that my wife passed and that she would be sworn in at the next ceremony. The interview was on Feb 12 and the next ceremony was scheduled to be held on Feb 20. We went to the office, but her name wasn't on the list. We haven't heard anything else since.

Have been in contact with our Congressman's office, but their contact at the Atlanta DO said that the IO was out of the office a few days and that he has still not gotten back to her. We already moved our flight back from late March to mid-April. We can't move it back any more as we both have to get back overseas.

I tried to schedule an infopass appointment, but the system says we have to wait 45 days after calling the 800 number and asking for help. But when I call the 800 number it just asks us for our case number and then tells us that the case is still at the Texas Service center, where it was last October. The internet case status says the same thing. The case status system is clearly broken.

It seems quite clear that our IO has basically forgotten about us or has been sick or something for a lot of days. His supervisor told us two weeks ago (when we showed up for the ceremony) that she couldn't do anything because the file was still in his office. In other words, he told us everything was done and that we should come back for the next ceremony and then forgot to turn the file over or put her on the list or whatever was his next step.

Does anyone know where we can go from here? The Congressman's office has promised to continue to harass their contact over at the Atlanta DO. But we are getting a bit desperate. I mean, if this doesn't go through before we leave, we may have to apply for a re-entry permit, b/c I am going to be working overseas until September 2010, and that is more than a year from our exit date.

Frustrating.

I understand that this is more than frustrating. But I don't have any other suggestions what you could do, besides calling USCIS and contacting your Congressman. One thing you need to make sure is that your wife doesn't miss the oath ceremony because she might have to start the whole citizenship process all over again if she does so. If she can't make it, make sure you ask for rescheduling and mail that certified with return receipt. If I were you, I would have her fly back to the States for the ceremony, in case you're overseas already. And make sure she doesn't break her physical presence when she comes overseas with you. I know if you're on military orders that counts as if you're living in the States and then you don't need a reentry permit. I'm not sure how that would work in your case. I keep my fingers crossed. :thumbs:

Thanks Stella. If I haven't heard anything from USCIS or the Congressman tomorrow afternoon, I think we will do plan B, an infopass appointment or some other way that we can visit the District Office before Friday's oath ceremony. I'm sure something will work out. It's just the wait that is frustrating, especially when we feel like we are so close to the end! I'm sure that the waits seem longer at the end of each process!

I bet that it's hard to wait. I'm so impatient which is actually so stupid since the whole process is actually pretty short. But I know that time starts to drag the closer you get to the end (it was the same each time my husband was deployed).

Exactly. It must be a psychological fact that time actually does slow down the closer you get to the end. A watched kettle never boils, etc. I remember when we were waiting on the CR1 visa. It didn't come until we had forgotten about it and gotten busy with other things. As long as you are running to the mailbox it will never come.

And then we have this amazing support group, which has honestly kept my sanity through the whole process. I love VJ!

I need some help guys!!

I am preparing my N400 to apply under 319(B), I called the embassy in Cairo to schedule an appointment for finger prints and they said they no longer do that!!! they stopped doing ink finger prints THREE YEARS AGO!! they told me to head to a local police station where i get a popular finger print card here and use that instead!! would this work with home land security?!? a finger print card done by a police station in Egypt without a single english word on it!!

any ideas!??

The only thing I can say is that I had the same experience in La Paz, Bolivia. They said they were no long doing the fingerprinting. And then someone on VJ recommended that I call the embassy again and ask for the "security" section. I did that, and low and behold, they said, "Sure!" So we went in and they took us upstairs to this double-secret area and didn't even charge!

That didn't stop the Atlanta District Office from denying my wife's application because we didn't send in copies of our fight itineraries proving that we were leaving within 45 days of the naturalization ceremony. I'm not kidding. We have sent flight itineraries to the office, but they refuse to look at them since they weren't in the original file. We have to file a costly appeal or re-apply.

Good luck. I would definitely recommend applying through Washington, DC. But if you are with a big company it shouldn't be a problem. I own my own company that does business overseas.

I would just bring travel plans and work orders to the interview. And even if the interviewing officer looks at them and returns them to you saying, "That looks fine," you should request that he keep the copies and put them in the file. What happened with us was that he looked at them, said, that's fine, you pass, and then went on vacation or something. The next officer who took the case off denied it because there was no evidence that we were really leaving to go abroad. We were furious and now have to file an appeal which will probably take so long we will no longer meet the requirement that I be posted overseas for one year after my wife's naturalization.

I would say applying through the Washington, DC office would be best. But either way, just realize that you have to prove everything beyond a reasonable doubt (the burden of the prosecution in a criminal case), and you have to get all that evidence in the file. Because once they deny, it is very difficult to have it reversed without a very costly and very lengthy appeal.

I am about to apply under 319b.. I just got my LPR 2 months ago. My husband is already in italy (Im in the states). My question about the 3 year as LPR being waived was answered.. now do I need to be residing abroad to apply under 319b ?? or can I apply here in the states and then go with my hubby? Thank you for answering in advance.. I really appreciate it because Im so confused! :unsure:

I'm contractor in Kuwait filling under section 319(B). Here's my problem:

1. My wife and I do not own nor lease property stateside, therefore no utilities. But, we both have the same physical address which happens to be my aunts house.

2. My wife has a different stateside bank. No joint account.

3. In part 6, section B of the N-400 it asks for employment history. I know this a no-brainer, better safe than sorry, but she hasn't worked since October 2004 ( married JAN. 2006, GCH April 2008). Any advice would be great. Thanks in advance.

Let me tell you my situation.. maybe you can use this as a guide in her application.

Me husband got married in 2005- I received my greencard in Nov 2006, I applied for naturalization in March 2008- got naturalizad in July 2008.

My husband and I does not have any properties in the USA, therefore no utilities as well, BUT like you, we are using his sister address as the physical address.

My husband and I files taxes jointly.

My husband and I have joint account in the USA.

Question no. 1

answer: she can use your aunt's physical address overseas.

Question no. 2

Answer: no worries on this..as long as you file the taxes together that will be a better proof, or a birht certificate of your kids if you have any to include in her application.

Question no. 3

Answer.. if she doesnt work, there is nothing the USCIS can do, so dont worry about this as well.. Just be honest that she did not work for the last 5 years.

My question now is:

Do you have an LOI or orders from the military as a contractor overseas? She can use this to prove that she is here living with you overseas.. I PM you the information on the article 319b. .
