Timeline

Hi everyone first here is a quick overview of our time line....

We were married October or 2006 and filed AOS application in March of 2007. Had our case denied in August of 2007 and then reopened two weeks later due to a problem that USCIS made. (They received our RFE and put into the wrong file, it was for the I-485 and they but it in the I-130 folder) It was a long and rough two weeks because we never received the actual denial notices and to this day still haven't received them. After being reopened we finally received his EAD in October of 2007 along with a interview date (Hurray!! So we thought). Our interview date was December 19th 2007 in Sacramento California. We went to our interview and everything was going smoothly (so we thought) we went through the basic yes and no questions and then got into the personal questions. They were just basic where did you meet and how, and basic questions that you would only know if you lived together. The one thing that did throw me for a loop was that the IO asked if my husband has ever met my exhusband!! Why on earth would that meeting ever happen...just my thinking. Anyways back to the interview, after asking her questions to us she was flipping through our file looking for our sponsor's information and was looking at his passport photo and lost her place and when going through the file again to find the photo she came across a paper that showed that my husband did not register for NSEER's (for those who don't know it is a exit/entrance registration for arab men from certain countries that was implemented after 9/11). She then asked why he had not registered and he answered that he did not know of the registration and he was never contacted by USCIS with a time or place to register. We were told that he would be contacted by ICE to register and then our GC would be approved. So we left the interview without the GC!! We were kinda upset but weren't to worried we just figured that ICE would contact us and he would reigister and it would just work itself out.

So we waited two months to hear from ICE and after they finally contacted us it took us a month to get ahold of the ICE agent that we needed to talk to. By this time we have already passed the 30 days from the new RFE that they sent us after the interview to show proof that we had registered with ICE. However the ICE agent said that he would take care of it. Well to make the rest of the store short they did not take care of it and now my husband is is removal proceedings and we have a court date set for July 15th 2008. We have hired a lawyer but I was just hoping to find someone on here that has been placed in removal proceedings and lived through it! I wasn't scared about going in front of the judge...we have nothing to hide but as the day comes closer I am starting to worry!! I can't lose my husband because of a mistake on USCIS and ICE! So if anyone has any advice it would be greatly appreciated. Again sorry this was so long but our story could actually fill a book. Thanks for taking the time and reading this and if you reply thanks in advance!!

Melissa (worried she's going to loss her husband)
