My wife (Brazilian) and I (US) were married in Brazil at a civil ceremony. I came back to the US and began the K-3 visa process (which I still haven't received my NOA.) During this time, we've decided to have the marriage annulled which can be done within a year of the marriage, and we believe we have an acceptable circumstances. My questions are:

1) We had to sign a pre-nuptual (50/50 ownership) since we never lived together and never shared any assets, could we nullify the pre-nuptual before we get the annulment?

2) Do I need to fly back to Brazil to sign paperwork, or can it be done through a lawyer or consulate?

Sorry about the divorce. You may want to post in the regional forum. Someone there may have went through the same process and they might not be so critical. I'm sure professional legal advice would also be warranted.

You are not going to find anyone here that is famikiar with the Brazilian legal syste,

Have your wife contact an attorney in Brazil, and have him/;her take it to the proper authorities in Brazil.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Im pretty sure what fwaguy meant was that this is more of a situation for a lawyer, not a VJ member to give advice.

I am sorry that you have decided to get divorced. It always breaks my heart when I read about this. I truely hope that it is for the best. I agree that you should post this question in the country specific area. And I would consult with a good legal immigration attorney on the issue.

it will involve immigration as well. Because of the petitions involved and any future plans on going through the immigration proces.

Cancelling a petition that has not been approved does not require an attorney..

A simple "Please stop any further processing on my previously filed I-130 and/or I-129F petitions referenced numbers WACXXXXXXXXXX and/or WACXXXXXXXXXX effective immediately." certainly will suffice.

your opinion is your opinion. Unless you have personally gone through the situation, you cannot give someone a generic answer and tell them that is the gospel. All cases are different and if they choose to pursue another visa, they should contact an attorney. So having a family law attorney and an immigration attorneys point of view is not going to kill someone. Most lawyers will give a free initial consultaion. So there is no harm in getting all the information from different places.
