Timeline

Hi All,

I applied for K3 after 4 months of applying I130. My I130 just got approved on May 4th, 2006 after 4 months waiting period. Can someone tell me if I can still be qualifying for K3 visa and is it faster than I130(CR1). Does any one know how much time is taking for NVC to receive the papers from USCIS.

12/19/2005: I130 Mailed.

12/22/2005: I130 NOA1 (Notice Date).

05/04/2006: I130 NOA2 (Approval).

05/17/2006: NVC assinged case#

05/29/2006: DS3032 and AOS bill fee generated.

06/01/2006: DS3032 and AOS bill fee sent, Express usps mail.

06/16/2006: Received IV Bill form and I-864 package.

06/19/2006: Send IV bill and I-864 express usps mail.

06/22/2006: IV bill fee entered in NVC system.

06/30/2006: DS-230 has generated

06/31/2006: Received DS-230.

07/10/2006: Sent DS-230

07/28/2006: Sent Passport Biographic page. Delayed because of name change.

08/08/2006: Case Complete @ NVC

08/17/2006: Case forwarded to embassy.

09/07/2006: Spouse received Packet 3.5 from embassy.

09/18/2006: Spouse send packet 3.5 to embassy.

10/20/2006: Wife arrived in US.

I29F K3

05/01/2006: I129F sent.

05/15/2006: I129F NOA1.

08/07/2006: Email approval notificationl of I129F.

08/14/2006: Case forwarded to embassy.

08/28/2006: Spouse recieved packet 3.5 and date of interview.

09/05/2006: Embassy canceld K3, since CR-1 @ embassy.

since your I130 is already approved, you will probably not get your K3 before that and if they both reach the embassy, the K3 will be canceled.

So it might be best to await the I130 process and get the CR1

My wife's I-130 got approved on April 27th and NVC recieved it on May 9th (12 days) , my Stepdaughter's I-130 got approved on May 2nd and received by NVC on May 8th (6 days).

The question is not how fast NVC is processing visas , the questions is how fast the US Embassy is processing interview dates at your country. In my case I'm still waiting for I-129F approval and if I get approved this week and sent to Colombia my wife and child will be with me in approximately 2 months and with I-130 already approved and if I use Jame's short cuts I estimate between 3 1/2 and 4 months (disadvantage= 2 more months without them, advantage= they will come with CR1 and CR2).

Check the timelines of other VJ's members to estimate the wait period of your country.

If your I-130 gets to the embassy before or concurrently with your I-129F, the embassy will not process the I-129F. Which it is beneficial to you and your spouse that the I-130 is processed instead. She will have a 2 year Green Card Conditional and get SSN and freely travel etc like right a-way without any additional paperwork for at least 2 years minus 90 days of her arrival date in the USA. But its possible your I-129F may slide through and get to the embassy before your I-130 does--if so they will process it.

Currently the NBC where your I-129F would be processed is processing petitions with a receipt date of Feb 21. Which means you are looking at approximately 2 1/2 months before it would be approved if you sent it off now. It also would depend on if there was any name hits etc during the security checks. Having the I-130 approved already and using James Shortcuts or the Timesavers (The link for which you can find in my signature) should get you through NVC in approx 2 months depending of course on how diligent you are in sending the forms/bills to NVC. It is taking roughly between 2-3 weeks for NVC to receive petitions from the service centers.

On saying that.....submitting the I-129F as well does cover your bases in case your I-130 is held up for whatever reason.
