disability am i screwed?

I, the petitioner, and im on Ir1 route. didnt work for 2 years due of staying with my husband in the philippines, my sister who is my joint sponsor shes on disability for 3 months bec she gave birth.

we are about to send the AOS form to NVC but i dont know if we going to have a problem bec of her disabily for 3 months. her last income tax return is around 60k ,the last paystub she have right now from her work is for dec 2007 last year. but since shes on the disability she have her disability paycheck copy . She got back to work last june 25th. and she have an employer letter as a prooft that she back to work... please advise us bec we dont know what to do regarding this matter please help thank you so much

Shouldn't be a problem because it is based on income so even disability checks are income. Her last tax return at 60K is good. Include the employer's letter about her return to work.

Basically, your employer letter should state "To whom it may concern: (first name,last name) has been employed

full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an

annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company

I think as long as your sis provides the required info, you should be ok. If she is receiving income, then it will be included. If she has plans to return to work, maybe her boss can write a letter stating the day she anticipates to return to work and what her hourly wage is along with how many hours a week she works. May, just a suggestion, they can add how long she has been employed there so they can see job stability.

The issue is how much of her last years income was from disability - is it enough to disqualify her from sponsoring? Secondly, will she continue to get disability as a form of income.

If you can demonstrate the disability income is neglible and she has sufficient means of income from a regular job, it may be ok to still use her as joint sponsor.

hello guyz, thank you for your answers. my sis back to work last june 25th 2008 with employer letter stating she started to work there since 2002. they put her hourly rate and her income last year is 60k plus she have 12k in her bank. so we put all that in AOS. is the disability since shes on in last 3 months counts as public charge? please help ty..

Nicole, she is stable at her job. but due of giving birth she have to rest for 3 months. her schedule to back to work from dec 2007 to june 25th 2008 . last month she started again. ty

the disability will not count as a public charge. It was maternity leave, so it will not count against her.
