i have a problem.. i will be filing my I-751 on october but i feel like i dont have enough evidence because my husband have a bankruptcy problem and so we dont have that mucH documents to file because we cant even get a loan under his name , alot of credit card wont approve him for anything. and if i put his name on my car insurance we have to pay double and we cant afford it right now. i got a good loan for my car because im working in a bank now but they wont allow his name to be in my account because he's on the chex systems. only one bank allowed him to open an account but that bank is far from our house. as of now we have:

income tax return

apartment lease

picutres

a letter from pg&e that were responsible for payments

one credit card with my husband being secondary user

joint accounts

copy of my alien card

marriage certificate

copies of our refund checks from the IRS

cellphone bill with my name on it (with the same address )

i think thats all we have... im really worried about it i wonder if i should send them the papers that my husband has a bankruptcy problem and thats why we only have few documents to show.. help please thank you so much!

Since you have a car, does your title have both your names on it?

Health insurance?

Affidavits can always serve as good (extra) evidence.

Pay slips for both of you at the same address perhaps?

Correspondence addressed to both of you?

Incidentally, assuming he's the US citizen, how was he able to get through the Affidavit of Support (AOS) phase (the I864 when first applying for residency) to sponsor you? Assuming that if he got a co-sponsor, you could always get a letter from his co-sponsors as evidence of the financial situation.

If you feel that your documents might be inadequate, then explain your situation in the cover letter. Assuming your job provides enough income for the two of you to live, you should not have a problem. Have everything prepared and file as soon as possible. Your husband's bankruptcy is just a bump in the road of life. You will both get through this.

yeah im planning to get affidavit from my sister in law and brother in law, my brother in-law co-sign for me to get the loan for the car since my husband has bad credit.

i forgot i do have health insurance that my husband is my beneficiary because his job doesn't give him any benefits at all..

i have another problem, since my husband work in san jose and he's there all the time does it matter on the address on his w-2 was still his old address i guess he forgot to change it and im kinda worried about it too..

we cant apply for any IRA accounts or anything at this time because of our income, we barely travel because we work all the time.. were trying to save money so i could go back to school and study nursing.. i dont know im just worried...

we do have health insurance from my job and he's my beneficiary coz his job doesnt provide any kind of benefits.. i think on our first application, my brother in-law sponsored us financially, now that im working i think were gonna be okay because im currently working 2 jobs.. and our bills like cable and cellphone it's only under my name bcoz they said that they couldn't include his name coz they can only put one name on the bill.. on his paychecks i guess he forgot to change the address coz he works close to his old house where he use to live with his sister so he didnt change it would that be a problem? but our tax return were all mailed to our house and all that..

They don't actually look at your finances per se (although I've wondered how true that really is), so they don't really care about your income. I asked about the co-sponsor because you could get a letter from them (your brother in-law in this case) to write an affidavit for you where he can also explain your husband's financial situation.

With phone companies, even though the bill may be addressed to one of you, you are able to add someone as a full access contact, so you could call your provider and ask them to do this. However bills addressed to at least one of you at the address is still some proof of co-habitation so you should still be able to use those.

You said "I live with my parents" and not "we live with my parents". In another post you said "he works in San Jose and he's there all the time". Where does he stay?

In your first post you said that you are submitting an apartment lease. Is it under your and your husband's name?

sorry what i meant to say is that "we live with my parents" and he is on the apartment lease also.. my husband forgot to change the address on his pay stubs so his w2 has his old address where my in-laws live. do you think that will be a problem? i already told him to change it..

no we dont have any membership at all.. we barely have time to go out because were always working and saving money...
