SUPER CONFUSED WITH THE U.S. IMMIGRATION INSTRUCTIONS ABOUT I-134

it clearly stated that...

The NVC will send the applicant a packet with the visa interview appointment date, information, the application forms and a list of required documents. It is important that visa applicants submit all documentary requirements to NVC so they are "documentarily qualified" for the visa interview, otherwise, they will be found ineligible for visa issuance and be asked to return to the Embassy for another appointment.

...then following this statement are the list of documents including the I-134

me and my fiance had a discussion about where are we REALLY gona send the I-134. he was able to talk to a friend of his who told him that the he (the petitioner) needs to submit the I-134 to the NVC

WHICH CONTRADICTS THE STATEMENTS OF THE VJ PEOPLE THAT THE 1-134 IS PRESENTED TO THE CO BY THE BENEFICIARY DURING HER/HIS INTERVIEW.

could you please help me make things clear for us cus even i got so confused with that..even a statement from the manila usem website says....

it says...

"The NVC will notify the beneficiary when the priority date of his/her petition becomes current (or when a visa number becomes available) and will provide all the necessary information and application forms to start the immigrant visa application process. In almost all cases, the Affidavit of Support and the visa application fees are processed at the NVC."

can u please include the exact u.s. immigration web links ( uscis, NVC, manila us embassy) that explains my concerns..

yes it is required but my concern is does the petitioner needs to submit it to the NVC or the beneficiary will be the one who will presen that to the CO at the manila USEM

Hi shes, I assume you are on K1 category. Based on our experience (as a K1 applicant), I brought along with me the Affidavit of Support in my interview. It was asked by the pre-screener. It's one of the most important docs that they required for you to give them.

I tried to search the new interview procedure in USEM website but could not find it. We only knew this new procedure btw through the threads posted here by April interviewees. If I remember it right, they were the first batch to undergo this new procedure.

you should submit notarized completed I-134 AFFIDAVIT OF SUPPORT FORM,PETITIONER RECENT U.S FEDERAL income tax return(FORM 1040)and wage statements(FORM W-2)EMPOYMENT LETTERS stating salaries and bank statements......jus bring this during your interview

Most of the VJ members who have gone thru with the process , say that I 134 is sent to the beneficiary to be submitted to the consul during the interview. My fince called NVC while our NOA2 was in process last April, and asked when and where to submit the affidavit of support. The lady in NVC said to wait for their instructions after the NOA2 is received when my fiance asked "is it ok that we send the affidavit of support now to USCIS?". She also said that affidavit of support will be submitted to NVC.

What I wonder is the lady might not really comprehend that we are in application for K-1 visa (which is non-immigrant). I think, only those whose application is for immigrant visa are required to submit affidavit of support to NVC. This is also clear at this link from USEM website.

Well, I guess , the best thing to do is call NVC and ask. My fiance has been calling NVC about this. He just waits for the timing that he will be able to talk to a live person.:)

This new process is confusing. Anyhow, based from experience, our first Affidavit of Support was submitted to the USCIS together with our I-129 Petition. After it was approved and I had my interview and medical schedule, my now husband sent me a more recent Affidavit of Support which I submitted during the interview.

After the approval, the USCIS will send the petition to the NVC, then the latter sends it to the USEM after a MNL case number is assigned. I can vouch that the USCIS sent the WHOLE petition to the NVC and the NVC sent the same to the USEM because when I was interviewed, I actually saw the CO perused our I-129 form and the other documents we submitted to the USCIS. Therefore I can only assume that the you need not send another Affidavit of Support to the NVC because they already have the whole file from the USCIS after approval.

Just a thought. Goodluck on the process

as K1 you don't need to send any documents to NVC.. you have to bring all your required documents and present it at the embassy during interview.

Application Procedures for the K Visa (i'll jump to step 2 coz step 1 is just filing for I-129F)

STEP 2: USCIS approves the petition: Once the petition is approved, USCIS sends it to the National Visa Center (NVC). NVC forwards the petition to the Embassy in Manila.

STEP 3: The applicant is notified: When the Embassy receives the approved petition from the NVC, it notifies the applicant of the medical examination and visa interview.

STEP 4: Apply for the visa: After the applicant pays the non-refundable application/processing fee and completes the required medical examination at St. Luke's Medical Center Extension Clinic, he/she appears at the Embassy for the scheduled visa interview with all the required documents.

The affidavit of support will be sent to you by your sponsor (fiance) for your interview. No need to send it to NVC or USCIS. My fiance just talked to NVC and US Department of State last night to get our manila case number, and he was told that no need to send the I134 to them. That form should be given to the benificiary.
