applying waiver to I-175

:unsure: I am currently waiting for my final decree of my divorce from my husband (who filed for me but filed jointly – 6 months dissolution of marriage) this week. I am anxious for this upcoming submission of my application – applying a waiver for I-175 – coz I do not know what would be the outcome. The divorce was due to irreconcilable differences.

We’ve been married for just a year. The separation happened just when I received my Conditional PR.

I do have enough correspondence and/or email between the two of us since my physical separation from my husband as of last year (August 2007). Our correspondence covered his intentions of me need to be out of his residence, legal separation before divorce, financial status though we do not have a joint account – but his personal check intermingled with my own account since I worked. My personal check addressed to his residence if I need to prove that we do lived together. I have pictures of us together during and after the separation.

I do have a copy of our 2006 tax return filed married and 2007 filing married but separate.

I have 2 close friends who knew him and who knew me who are willing to submit an affidavit letter of support for my application. Both of these friends are aware of our marriage status.

Are there anybody file the same case as I do? Where you ask for an interview? Are there RFEs you need to submit? I cannot afford to have an attorney for this application but I would be willing to file it by myself.

I just need to know if there is anybody has the same case as I do.

I did not understand quite well, did you filed previously joint or not?

In any case, you just must wait for the final divorce decree. In the meantime you should be building your package with all the evidence that you have. would be wise to put a short letter explaning what happened.

Do you owned things, bank statements, savings, bills? do you have all that? You need to gather all possible how comingled your life was before your separation. Affidavits is a good idea at this stage.

No I have not file and/or apply for I-175 yet but I am about to a month from now. And yes, I am waiting for the final divorce decree to come out soon. And yes, I have a letter prepared explaining what had happened.

I am just concerned and anxious for the application...

If you are talking about the I-751 you have to prove your marriage was in "good faith" and without intentions of circumnavigating the immigration system.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

While waiting for your final decree, you have to start gathering ALL that is needed in filing your I-751 waiver. The RFE's are sent to you if the USCIS thinks you need more proof of your marital union or you're lacking one of the requirements etc..Mine was filed with a waiver back in 2006. I sent the requirements, got an RFE then sent it back to them and got approved afterwards. Every case are different.Goodluck.
