Dear all,

I have a friend that she want to apply for fiance visa. I know the step for this so I can explain to her. But she has special case, she has a daughter that this little girl doesn't have legal father. I mean she is single mother, and never been married. For one reason this mother and her ex boyfriend not married. And she met an American guy now. And this couple want to apply fiance visa. But they still don't have any clue about visa for this little girl.

My question is what kind of visa for bringing a child who have not legal birth certificate? Or do you think this mother should make a birth ceritificate? How? Or her future fiance can adopt this girl?

For now, the petitioner simply lists the daughter on the I-129F where it asks to list the beneficiary's children. The daughter will need a birth certificate and a passport. After the petition is approved, the mother and daughter will be allowed to apply for K1 and K2 visas. There are instructions for what to do if a required document isn't available but usually a birth certificate can be obtained.

In the Philippines LOTS of people don't have a BC as they were born with the assistance of a midwife.

They end up with a late registered BC. Best to get one ASAP.

Sometimes USCIS requires other proof of birth proving the person is whom the BC says they are.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
