Tourist VISA for My Wife

Hi all,

I am a US citizen and I applied for IR-1/CR-1 and K3 for my wife in March, I was wondering is there anything I can do from here to help my wife get a tourist visa so she can come visit for 2 weeks while we are waiting.

She can come visit via the I-94W Visa waiver program. It allows her to stay in the USA for up to 90 days. My husband just came to visit me in from Germany this past May. We had no problems. Do NOT overstay the 90 days period and you're good. No tourist visa needed.

Indeed! If your wife's country is on the Visa Waiver Program, then she does not need to apply for a tourist visa.

However, that does not necessarily mean she will be granted entry. This topic comes up often in the Canada forum. We have recommended that the visiting spouse should bring plenty of documentation to show ties back home (i.e. home title or mortgage, apartment lease, letter from employer), and copies of paperwork from the USCIS or NVC (i.e. the I-797 NOA1 or NOA2 on the I-130, or letters from the NVC). And remember that entry to the US is subject to the border guard.

It goes without saying that being polite, and giving honest and open answers is the best policy. However, that does not mean to offer extra information.

Hello! Why dont you try to apply her a B2 (tourist visa), sad to say coz my american husband tried to get me a toursit visa and sadly the americal consulate refuse to gave me tourist visa....you can try and as long as your wife owns some properties and she has work, that would be fine..coz some consulate wont grant tourist visa to an american spouse, coz they suggest to wait for the right visa for your wife and thats what american consulate told me...hehehe i get a little bit depressed but im ok coz we got my approval and Thanks God!!! There is absolutely no use for a tourist visa in this case. You will have to go through so much and make useless payments. You are allowed up to 90 days with the visa waiver program (your wife just needs her passport).... as noted above.

Morocco is NOT part of the Visa Waiver Program (VWP), do not try this as it will absolutely result in a denial at the Port Of Entry. These are the only countries whose citizens can use the VWP (Perhaps you were thinking Monaco?)

Agreed!!! My wife tried before applying for the I-130 and was denied asked to only come back to apply ONLY for an Immigrant Visa. Even though it would not adversely impact your wife's migration, it is simply a waste of money and time and most importantly an emotional toll when both of your hopes get dashed. I know if was a bad experience for my wife and I. With the I-130 process moving quicker than 6 months ago it should not be too long before she would be able to migrate!

If your wife does not have strong ties to her country (job, property owner etc...), the denial chance is very high.

My wife is Canadian resident, my son is Canadian. She got denial of B2 visa twice already. I just want to spend time with her

and my son here in US for a month while waiting endlessly for visa I-130. They recommend to wait to get

visa from I-130 pending process. Try only if your wife can prove to them she has strong ties to her country. Otherwise, do not waste

your time & money. Good luck

It's sad but true. We experienced the same thing. The visa waiver program was useless, applying

for a visitor visa was just a waste of money. The U.S. is just a very strange country with very

strange rules. The only option is to wait it out. I was lucky, since I was able to move to Japan to

be together with my wife through all these horrible long months of waiting for something to happen.

Most are not as lucky, so denied to be with your SO, not even for a couple of weeks during that

period, is just plain ludicrous.
