HELLO EVERYONE, I HAVE A QUESTION REGARDING MY PETITION. I USED AN IMMIGRATION ATTORNEY TO FILE MY K1 VISA BACK IN MARCH 18 2008. IT HAS BEEN A FEW MONTHS ALREADY, AND I HAVE NOT RECEIVED MY NAO2, OUR PETITON WAS UPDATED ON APRIL 7 2008 BU USCIS. IN THE K1 VISA PETITION PAPERS THAT MY ATTORNEY SENT TO VERMONT SERVICE CENTER, THE ATTORNEY DID NOT INCLUDE AN COVER LETTER, HE ALSO DID NOT SEND A LETTER OF INTENT FOR EITHER ME OR MY FIANCEE, BUT EVERYTHING ELSE WAS SENT , ALL THE IMMIGRATION FORMS, ALONG WITH EVIDENCE, AIRPLANE TICKETS,PICTURES OF US TOGETHER, BIRTH CERTIFICATES AND ETC.MY QUESTION IS, WILL THIS BE AN ISSUE WHEN IT COMES TIME FOR VERMONT TO APPROVE OUR CASE?

The letters of intent are a pretty important part of the process. You will most likely receive an RFE for them before your case can be approved.

If I were you, I would have them all ready to go so that when you receive the RFE, you can just pop them in the mail with the letter that USCIS sends you.

I wouldn't worry too much about not having received NOA2 yet. I've seen from other March filers that Vermont has slowed down a bit after they moved at lightning speed during the first quarter of the 2008.

As for your concerns with regards to your attorney. I can only talk about our experience (we hired a lawyer and wish we hadn't). The attorney should've most probably included a cover letter. As far as I remember there is also a special of form that the lawyer has to include, citing that both the petitioner and the beneficiary are confirming the legal presentation through law firm XYZ. I am surprised to hear that no letters of intent were included. The worst that can happen is that you're getting an RFE for that. Then all you have to do is send Vermont the requested information.

In my opinion, since you have most probably paid a good amount of money for your attorney, I would consider terminating the legal representation if you receive an RFE. A qualified immigration lawyer should know what to include in a petition.

Don't stress to much at the moment. It's out of your hands. Wait until you hear anything from Vermont.

Have you called the attorney? I don't know anything about how it works since I don't have one, but would the RFE go back to the attorney or come directly to the petitioner? If it goes to the attorney, perhaps they are just sitting on it and forgot to let you know.

I would be checking on it because 34 March filers with dates after his have their NOA2. Most with his same timeframe have had theirs a month now.

Give it 4 months then call your attorney if you don't hear anything. Check your status online every other day since you're now in 3 months window, closer to your adjudicated date. No cover letter and letter of intent, unless it is from a well-known Attorney to USCIS in Vermont. You're highly likely to issue RFE...

I can tell you this my lawyer was not that bad but he did not do a good job. But him not sending photos, et.c will definitely hurt your case. I only did not send a corrrect divorce paper and it sent it back 3 months.

Do not worry about the letters of intent. we also used a lawyer and she didn't ask us for anything like that.

we have our NOA2 already and i am sure yours is on the way also!

if something was wrong i think you would have received an RFE by now...
